Deposit amount proposed to be increased: · Commercial New Construction Ordinance Authorizing Council to Approve Deferral of Fee Payments: · The proposed uncodified ordinance would allow the City Council to authorize a deferral of the payment of fees related to development projects if property owners enter a related agreement with the City. Such agreements will state that a certificate of occupancy will not be issued until fees are paid and will provide that the City may recover its enforcement and collection costs. · Deferrals granted would extend the time for payment until issuance of a certificate of occupancy. · This ordinance would not cover deferrals for payment of the Parks Impact Fee, which will continue to be granted pursuant to Section 18.258(C) of the municipal code. · The resolution attached to this staff report directs staff to add language about payment deferrals to all applicable fee schedules. Municipal Code Amendment to Allow for Expanded Cost Recovery for Code Enforcement: · Section 1.20.8 of the municipal code authorizes an administrative hearing officer to assess administrative costs against a violator when she/he determines that a violation has occurred and that compliance was not achieved by the date of the hearing. In order to more fully recover the costs associated with municipal code enforcement, the proposed new section 1.10.9 of the municipal code would authorize departments to recover costs from violators prior to the conclusion of an administrative hearing. These costs are borne from enforcement activities, including violation inspections and the administration of notices of violation. 8.B. - Page 4
