The City may choose to make multiple bid awards with no designation of primary, , secondary or backup supplier to provide an opportunity for City staff to select the supplier of a required product on a case-by-case basis. The criteria used in this case-by-case supplier selection shall include, but not be limited to pricing, proximity , of plant site and product availab.ility. ' , , REJECTION-DISCREPANCIES: The Council ofthe City of Redwood ~ity reserves the right to rejeqt or accept any proposal or bid or any pàrt or portion, thereof or any còmbination of bid items or bids, and further reserves the right to waive any informality or patent clerical error in any bid. In the event of discrepancy between item prices and total prices, item prices shall control. Notwithstanding the foregoing, such discrepancies shall constitute grounds for rejection of all or portion of any bid. ADDITIONS AND ALTERATIONS: All bids shall be made on the bid form furnished by the City. No additions, alterations, exceptions or conditions other than specified herein wifl be permitted. Letters of transmittal cannot be considered part of the bid, and no conditions, reservation.s or exceptions stated herein shall alter or affect the terms of the bid as stated in the bid form. . BID PRICE: Bids will be compared on the basis of total net delivered price to Redwood City unless otherwise stated in this bid document subject to the provisions of Paragraph 5 above. The total net delivered price Redwo~d City shall include all applicable taxes, transportation, and costs of incidentals and àccessories, complete. 9. ROYALTIES AND PATENTS: The successful bidder shall pay all royalties and patent fees. He shall defend all suits and claims for infringements of any patent rights and shall save the City of Redwood City harmless from loss on account thereof. 10. PAYMENT: Payment will be made by the City to the bidder within thirty (30) days following acceptance of the bidder's performance by the City of Redwood City unless otherwise stated in this bid document. 11, PENALTIES AND TERMINATION OF BID: In the event the successful bidder refuses to deliver or provide the goods, wares, apparatus, materiaf or services, in the manner and within the time(s) specified, or fails or refuses to comply with any requirements of this bid document, the City of Redwood City may elect to take all or any of the following actions: ' (a) City may serve notice in writing upon the bidder of its intention to cancel its contract with bidder and purchase said goods, wares, apparatus, material or services from another source. Unless within ten (10) days after mailing of such notice the successful bidder shall make complete delivery and/or comply with all requirements of this bid document, the City may without further notice cancel the contract.
