<br />ATTY/RESO.0035/CC RESO CERTIFYING FINAL EIR – 1548 MAPLE <br />REV: 04-30-18 PR <br />Page 6 of 49 <br />BIO-3f: Standard Best Management Practices (BMPs) shall be employed to avoid <br />degradation of aquatic habitat by maintaining water quality and controlling erosion and <br />sedimentation during construction as required by compliance with the General National <br />Pollution Discharge Elimination System Permit for Construction Activities. <br />BMPs shall include, but not be limited to, installation of silt fencing and erosion control <br />wattles between Redwood Creek and construction activities. <br />BIO-3g: To prevent the entanglement of wildlife, no erosion control devices containing <br />plastic monofilament netting shall be used or stored on site. <br />Finding: Implementation of Mitigation Measures BIO-3a through BIO-3g would <br />reduce the project-related impact to the movement or habitat quality of white-tailed kite and <br />longfin smelt to a less-than-significant level. <br />Facts in Support of Finding: These mitigation measures establishes policies to be <br />implemented during construction to reduce potential impacts of construction activities on <br />wildlife movement and habitat, including Environmental Awareness Training and the location <br />of all refueling, maintenance, and staging equipment. <br /> <br />Impact BIO-4: Construction of the proposed project and the project variant could have <br />a substantial adverse effect on federally protected seasonal wetlands and freshwater <br />emergent wetlands as defined by Section 404 of the Clean Water Act, as well as waters of <br />the State as defined through the Porter-Cologne Water Quality Control Act. Up to 0.056 acres <br />could be affected by the proposed project and an additional 0.137 acres could be affected by <br />the project variant. <br />Mitigations BIO-4a: The project applicant shall obtain a Section 404 Permit from the <br />Army Corps of Engineers and a 401 Water Quality Certification from the Regional Water Board <br />prior to fill of jurisdictional areas or in-water work. The applicant will comply with all general <br />and project specific requirements issued by the Corps and Regional Water Board. <br />BIO-4b: All waters of the U.S. and waters of the State filled by the project shall be <br />mitigated as required by applicable agency permits that shall be obtained prior to the initiation <br />of construction. Mitigation may be accomplished by: (1) off-site creation of new seasonal <br />wetlands at an appropriate mitigation site; or (2) purchase of credits at an approved off-site <br />mitigation bank. <br />If the mitigation is to be accomplished by creating new wetlands at an off-site location <br />owned or otherwise controlled by the applicant, the applicant shall prepare and implement a <br />wetland mitigation and monitoring plan (MMP) detailing the mitigation design, wetland planting <br />design, maintenance and monitoring requirements, reporting requirements, and success <br />criteria. Mitigation wetlands shall be monitored for a minimum of five years to verify that the <br />success criteria have been achieved. The applicant shall also provide financial assurances <br />for the operation and monitoring of the created wetlands. The MMP shall be approved by the <br />Regional Water Board and the City prior to approval of the Final Map. <br />The purchase of mitigation credits from the mitigation bank would accomplish the goal <br />of the California Wetlands Conservation Policy (“No Net Loss Policy;” Executive Order W-59- <br />93) to “ensure no overall net loss and achieve a long-term net gain in the quantity, quality, and <br />permanence of wetlands acreage and values in California.” A credit purchase agreement or <br />receipt shall be provided prior to approval of the grading plan. <br />7.A. - Page 43
