AND, BE IT FURTHER RESOLVED: <br />That the City of Redwood City acquire said right of way <br />and easement in and upon said real property, for said public <br />improvement, by an action in eminent domain in accordance with <br />the provisions of the Charter of the City of Redwood City, the <br />provisions of Article I, Section 14, of the Constitution of the <br />State of California, and the provisions of the Code of Civil <br />Procedure of the State of California relating to eminent domain, <br />said real property being all that real property situate in the <br />City of Redwood City, County of San Mateo „ State of California,. <br />more particularly described as follows: <br />Parcel No. 1. <br />An easement five feet in width for the purpose of <br />installing and maintaining public storm drainage faci- <br />lities, said easement being described as follows: <br />A 5.00 foot wide easement adjacent to and westerly of <br />the easterly line of Lot 11, Block 1, as said lot and <br />block are shown on that map entitled "Friendly Acres <br />Subdivision No. 2," recorded January 18, 1937, in the <br />office of the Recorder of San Mateo County, California, <br />in Book 21 of Maps at pages 32, 33 and 34, said ease- <br />ment to be for the purpose of installing and maintain- <br />ing public storm drainage facilities. <br />AND, BE IT FURTHER RESOLVED: <br />That the City Attorney of the City of Redwood City be, and <br />he is hereby directed, authorized and empowered: <br />To institute, maintain and prosecute, in the name of the <br />City of Redwood City, an action in the Superior Court of the <br />State of California, in and for the County of San Mateo, for <br />the condemnation of the right of way and easements in and upon <br />the real property hereinabove described, for said public im- <br />provement, and to take all steps necessary for said condemnation <br />in the name of the City of Redwood City. <br />-2- <br />
