6. Permittee shall indemnify and save harmless the City of Redwood City, the City Council of the City of Redwood City, and the officers and employees of the City of Redwood City, and Leslie Salt Co. from any and all loss, liability, damage or injury, and from any and all suits, claims or actions brought by any person or persons for or on account of any loss, injury or damage what- soever sustained in, caused by, or arising or resulting from the construction, operation, use, maintenance and/or existence of said improvements and facilities, or sustained in, caused by, or arising or resulting from the course of any activity of Permittee in con- nection with the construction, maintenance or use of said facilities, or any consequences of the failure of Permittee to comply with and/or do all things herein required or mentioned by this resolution. 7. Permittee shall furnish and keep in full force and effect during the life of this permit, a certificate or policy of compre- hensive liability insurance naming the City of Redwood City as insured or additional insureds. Said public liability insurance shall be filed by Permittee with the City Manager and shall be ap- proved by the City Manager and the City Attorney before Permittee may exercise any privilege or right herein granted to it. 8. Permittee shall, at its own cost and expense, pay for all utilities of whatever kind and nature, including water and electricity used or consumed by it in connection with any activity carried on under the permission granted by this resolution. 9. The terms, covenants, agreements and conditions herein contained shall be binding upon the assigns and successors in interest of Permittee; provided, however, that no voluntary or involuntary assignment shall be made of the permission granted hereby without the written consent of the City Council of the City of Redwood City. -3-
