As such, strict <br />compliance with the NMPP height regulations would result in less residential units and <br />impact the project’s ability to build 15% below market rate units onsite; and <br /> <br />WHEREAS, on March 6, 2018, the Planning Commission considered whether the <br />Project is categorically exempt from the requirements of the California Environmental <br />Quality Act (CEQA), pursuant to CEQA Guidelines Section 15332 (Class 32 - "Infill <br />Development Projects") as explained in the CEQA compliance memorandum attached to <br />the staff report ("CEQA Memorandum"), along with the previously adopted Mitigated <br />Negative Declaration and Mitigation Monitoring and Reporting Checklist for the North <br />Main Precise Plan, the staff reports, oral and written, and testimony and materials <br />presented by all those wishing to be heard on this Project at the noticed public hearing <br />on this matter; and <br /> <br />WHEREAS, on March 6, 2018, the Plann ing Commission conducted a public <br />hearing in accordance with all applicable requirements of the Redwood City <br />Municipal Code and Zoning Ordinance, to consider the Planned Community Permit <br />PC2016-05, Density Bonus including a height concession, and the Affordable <br />Housing Plan, along with all applicable requirements of the State Planning and <br />Zoning Law, the North Main Street Precise Plan, and the recommendations of the <br />AAC; and <br /> <br />WHEREAS, the Planning Commission determined that the proposed Planned <br />Community permit would further the purposes of and appropriately implement the <br />City of Redwood City General Plan, applicable provisions of the Redwood City <br />Municipal Code and Zoning Ordinance, and the North Main Street Precise Plan and <br />adopted Resolution 2018-03 approving the Planned Community Permit PC2016-05, <br />Density Bonus including a height concession, and the Affordable Housing Plan; and <br /> <br />WHEREAS, an appeal was filed with the City during the 15-day appeal period <br />by Goolsby, on behalf of Better Neighborhoods Inc. (Appellant) challenging the Planning <br />Commission's approval of the Project; and <br /> <br />WHEREAS, on May 21, 2018 the City Council conducted a duly noticed de <br />novo public hearing in accordance with all applicable requirements of the State <br />Planning and Zoning Law, the City Zoning Ordinance and the North Main Street <br />Precise Plan, to consider the appeal of the Planning Commission's approval of the <br />7.B. - Page 27
