<br />acknowledging that there are not, to Tenant's knowledge, any uncured defaults <br />on the part of Landlord hereunder, or specifying such defaults if any are claimed, <br /> <br />and (iii) certifying such other matters as Landlord may reasonably request, or as <br />may be requested by Landlord's current or prospective Holders, insurance <br /> <br />carriers, auditors, and prospective purchasers. Any such statement may be <br />relied upon by any such parties. If Tenant shall fail to execute and return such <br /> <br />statement within the time required herein, Tenant shall be deemed to have <br /> <br />agreed with the matters set forth therein. Landlord shall similarly provide Tenant <br />with an Estoppel Certificate if so requested. <br /> <br />8.3 <br /> <br />Quiet Possession. <br /> <br />If Tenant is not in default as beyond any applicable notice or grace <br />period and subject to the Lease terms and any encumbrances to which Tenant <br /> <br />is required to subordinate this Lease under Section 8.1, Landlord warrants that <br /> <br />Tenant's peaceable and quiet possession of the Premises shall not be disturbed <br />by anyone claiming under or through landlord. <br /> <br />ARTICLE 9: LANDLORD'S RIGHTS <br /> <br />9.1 <br /> <br />Rules. <br /> <br />Landlord shall have the right reasonably to amend the Rules and <br />supplement the same with other reasonable rules (not expressly inconsistent with <br /> <br />this lease) relating to the Building or the promotion of safety, care, cleanliness or <br />good order therein, and all such amendments or new rules shall be binding upon <br /> <br />Tenant after five (5) days' notice thereof to Tenant. Nothing herein shall be <br /> <br />construed to give Tenant or any other person or entity any claim, demand, or <br />cause of action against Landlord arising out of the violation of such Rules by any <br /> <br />other tenant, occupant, or visitor of the Property, or out of the enforcement or <br />waiver of the Rules by Landlord in any particular instance. <br /> <br />~~/ <br />~ <br />
