• Provide value engineering support, including identification of potential risks and recommendations <br />for refinements to minimize impacts. <br />• Have informal discussions with property owners to share information and identify issues and <br />needs and confirm information. <br />• Coordinate with the City's Project Manager and involved City staff, the City Manager, City <br />Attorney, and City Council regarding statutes, processes, procedures and responsibilities <br />associated with right of way support activities including defining specific document templates and <br />language, preparation and review responsibilities, legal reviews, communication flows, and <br />contract signatories. <br />• Coordinate with the City's Project Manager and Caltrans Right of Way staff regarding Caltrans <br />procedures and oversight requirements. <br />DELIVERABLES (PRE-ACQUISITION CONSULTING) <br />• Memorandum of parcel risks and recommendations. <br />APPRAISAL SERVICES <br />• Appraisers will use the Caltrans approved Final RNV Appraisal Maps and initiate and complete <br />property appraisals. <br />• Appraisal reports will be prepared and compiled for review and comment by the City and subject <br />to oversight review by Caltrans Right of Way staff. <br />• Appraisals to be delivered as requested by City. <br />Appraisals will be prepared for acquisitions from 27 parcels, including one full acquisition parcel. <br />• Appraisals to be prepared in accordance with California Eminent Domain Law; California <br />Government Code Section 7260 et seq., including but not limited to Government Code Section <br />7267.2; the Uniform Standards of Professional Appraisal Practice requirements, except as <br />jurisdictionally exempt; the Caltrans Right of Way Manual; and 49 CFR, Part 24. <br />The owner or a designated representative will be invited by the appraiser to accompany him/her <br />during the inspection of the property. <br />• Appraisals to be prepared in an Appraisal Report format in accordance with the Uniform <br />Standards of Professional Appraisal Practice, Standard Rule 2-2. <br />• Appraisal is for the "Fair Market Value" of the property as per California Code of Civil Procedure, <br />Section 1263.320. <br />• The appraiser will issue the necessary public acquisition informational brochure and Title VI <br />information to all owners. <br />The market value of the property taken will not include any increase or decrease in the value of <br />the property that is attributable to any of the following: <br />• The project for which the property is taken; <br />• The eminent domain proceeding in which the property is taken; <br />• Any preliminary actions of the acquiring authority relating to the taking of the property. <br />• The appraiser will work directly with the furniture, fixtures and equipment appraiser. <br />AR/WS R/W Support Agreement iol/Woodside Project - Exhibit "A" I A-3 <br />ATTY/AGR.2018.09 1 /Associated Right of Way Services Inc. <br />
