good repair and in a neat, attractive and a safe condition, <br />likewise at its own cost and expense. <br />4. Permittee shall, upon receipt of notice so to do, and <br />within such time limit as may be fixed by said notice, alter, <br />remove or relocate at the expense of Permittee the said improve- <br />ments or any portion thereof to such extent as may be necessary, <br />in City's opinion, to avoid interference with any utility <br />facility or other structure now or hereafter to be constructed <br />by the City, or any other public utility, upon the subject <br />property. <br />5. Permittee acknowledges and agrees that upon revocation <br />of this permit Permittee shall, at its own cost and expense and <br />upon request so to do by City, remove the said improvements <br />placed upon the subject property. <br />6. In the event that the said improvements or 50 percent <br />or more of said improvements is destroyed or removed by <br />Permittee any time subsequent to the construction and installation <br />thereof permitted hereunder, for any reason whatsoever, the <br />permission granted hereunder shall cease and determine. <br />7. Permittee shall be responsible and liable for all damages <br />to persons or property, including the injury or death of persons, <br />due directly or indirectly to Permittee's construction and/or <br />maintenance of the said improvements, and the use permitted <br />hereunder, and shall promptly pay any just claim therefor and <br />shall hold the City of Redwood City, its Council, officers, <br />boards, commissions, councilmen, agents and employees, harmless <br />from all suits, actions, damages, or claims to which said City <br />may be subjected by reason of said construction and/or mainten- <br />ance of said improvements or encroachment or use there permitted <br />hereunder. <br />8. Permittee shall pay to the City of Redwood City the sum <br />of Fifty Dollars ($50.00) upon execution and acceptance hereof <br />-2- <br />
