245 <br />246 <br />ARTICLE 4 <br />SCOPE OF AGREEMENT <br />247 4.01 SCOPE OF AGREEMENT <br />248 A. Through this Agreement, Agency grants to Contractor an exclusive franchise, <br />249 except as provided in Section 4.01.8 and in Section 4.02, to Collect the following <br />250 materials in the Service Area: <br />251 1. Solid Waste generated at Residential Premises, Commercial Premises and <br />252 Agency Facilities; and, <br />253 2. Source Separated Targeted Recyclable Materials and Source Separated <br />254 Organic Materials generated at Residential Premises. <br />255 B. Through this Agreement, Agency grants to Contractor a non-exclusive right to <br />256 Collect the following materials in the Service Area: <br />257 1. Source Separated Targeted Recyclable Materials and Source Separated <br />258 Organic Materials generated at Commercial Premises; <br />259 2. Major Appliances and Specialty Recyclable or Reusable Materials generated at <br />260 Residential Premises; and <br />261 3. Non-putrescible wastes placed in Drop Boxes. <br />262 4.02 LIMITATIONS ON SCOPE <br />263 Agency may permit the Collection, Recycling, or Disposal of any of the following <br />264 materials by Persons other than Contractor without seeking or securing any approval <br />265 from Contractor: <br />266 A. Solid Waste, Targeted Recyclable Materials, and Organic Materials which are <br />267 transported personally by the Owner or Occupant of the Premises at which they are <br />268 generated (or by his or her employees) to a processing or Disposal facility; <br />269 B. Targeted Recyclable Materials and Organic Materials which are Source Separated <br />270 by the Generator and donated to youth, civic, or charitable organizations; <br />271 C. Recyclable beverage containers delivered for Recycling under the California <br />272 Beverage Container Recycling Litter Reduction Act, Section 14500 et seq. <br />273 California Public Resources Code; <br />274 <br />D. <br />Animal waste and remains from slaughterhouse or butcher shops, grease waste, <br />275 <br />and used cooking oil; <br />276 <br />E. <br />By-products of sewage treatment including sludge, sludge ash, grit, and screenings; <br />277 <br />F. <br />Hazardous Waste, Household Hazardous Waste, and Infectious Waste; <br />278 <br />G. <br />Source Separated E -Scrap and Source Separated Universal Waste; <br />279 <br />H. <br />Organic Materials composted at Residential and Commercial Premises; <br />REV: 03.16-16 MI <br />Page 9 of 126 <br />ATTY/AGR.2018.0541Recology of San Mateo <br />
