2253 ARTICLE 8 <br />2254 REQUIREMENTS FOR OPERATIONS, <br />2255 EQUIPMENT, AND PERSONNEL <br />2256 <br />8.01 COLLECTION HOURS AND SCHEDULES <br />2257 <br />A. Hours <br />of Collection <br />2258 <br />1. <br />Residential. Residential Solid Waste, Targeted Recyclable Materials, and <br />2259 <br />Organic Materials (including all such services provided to SFD and Multi -Family <br />2260 <br />Dwelling Premises) shall be Collected on weekdays (i.e., Monday through <br />2261 <br />Friday) between 6:00 a.m. and 6:00 p.m. exclusive of Holidays defined in <br />2262 <br />Attachment A for Collection service. <br />2263 <br />2. <br />Commercial. Mixed Use. and Aaencv Facilities. Commercial, Mixed Use, and <br />2264 <br />Agency Facilities Solid Waste, Targeted Recyclable Materials, and Organic <br />2265 <br />Materials shall be Collected on weekdays (i.e., Monday through Friday) <br />2266 <br />between 3:00 a.m. and 6:00 p.m. and weekends (i.e., Saturday and Sunday) <br />2267 <br />between 6:00 a.m. and 5:00 p.m., exclusive of Holidays specified in Attachment <br />2268 <br />A for Collection service. The Agency may restrict or require modifications to <br />2269 <br />hours for Collection from Commercial Premises, Mixed Use Buildings, and <br />2270 <br />Agency Facilities to resolve noise Complaints, and, in such case, the Agency <br />2271 <br />Manager may restrict the allowable operating hours. <br />2272 <br />3. <br />Commercial. Mixed Use, and Aoencv Facilities Exception. Collection from <br />2273 <br />Commercial Premises, Mixed Use Buildings, and Agency Facilities that are <br />2274 <br />two -hundred (200) feet or less from Residential Premises shall only occur <br />2275 <br />between the hours of 6:00 a.m. and 6:00 p.m., Monday through Saturday and <br />2276 <br />all such operations shall be in accordance with permissions provided to <br />2277 <br />Contractor by Agency. The Agency may restrict or require modifications to <br />2278 <br />hours for Collection from Commercial Premises, Mixed Use Buildings, and <br />2279 <br />Agency Facilities to resolve noise Complaints, and, in such case, the Agency <br />2280 <br />Manager may restrict the allowable operating hours. <br />2281 <br />4. <br />Exception. In the event of an unforeseen circumstance, the Contractor may <br />2282 <br />Collect materials from Residential Premises, Commercial Premises, Mixed Use <br />2283 <br />Buildings, or Agency Facilities that are two -hundred (200) feet or less from <br />2284 <br />Residential Premises between the hours of 3:00 a.m. and 6:00 p.m., Monday <br />2285 <br />through Saturday, upon prior written approval from the Agency Manager. <br />2286 <br />5. <br />Local Noise Ordinance. If an Agency ordinance regulating noise limits the <br />2287 <br />hours of Collection more restrictively than the preceding subsections, the terms <br />2288 <br />of the ordinance shall govern. <br />2289 <br />6. <br />Modification. The Collection hours and distances set forth in Sections 8.01.A.3 <br />2290 <br />and 8.01.A.4 may be adjusted by mutual agreement of Agency (acting through <br />2291 <br />the Agency Manager) and Contractor (acting through its General Manager), <br />2292 <br />provided that the Collection hours and distances are at all times consistent with <br />2293 <br />Agency ordinances. <br />REV: 03-16-18 MI <br />Page 56 of 126 <br />ATTY/AGR.2018.054/Recology of San Mateo <br />
