Contractor shall maintain a spare ratio of ten percent (10%) for all 2526 Collection vehicles used in the SBWMA Service Area. It is contemplated that, as of 2527 the Commencement Date, all Collection vehicles will be vehicles that Contractor 2528 purchased during the term of the 2009 Franchise Agreement and will be nearing the 2529 end of their useful life. 2530 Contractor shall purchase and place into service after the Commencement Date all 2531 new vehicles to replace its Collection vehicles and other vehicles used by 2532 Contractor in the SBWMA Service Area in accordance with the Contractor -prepared 2533 equipment replacement schedule in Attachment N. The new vehicles shall replace 2534 all vehicles in service on the Commencement Date. The vehicles shall be 2535 purchased and placed in service in accordance with the timeline shown in 2536 Attachment N unless an alternative timeline is agreed upon by the SBWMA 2537 provided that all new vehicles shall be in service on or before June 15, 2026. The 2538 estimated depreciation and interest expenses for the acquisition of new vehicles 2539 shall be included in Contractor's Compensation for 2021 and adjustments during the 2540 Term shall be made in accordance with Attachment K. Agency has no responsibility 2541 to pay Contractor for remaining net book value of any Vehicles, Containers, or other 2542 equipment that is not fully depreciated at end of Term, unless Agency elects to 2543 purchase Containers pursuant to Section 8.05.F of the Agreement. 2544 At no time after the Commencement Date shall any vehicle used to perform the 2545 services required under this Agreement exceed fifteen (15) years of age from the 2546 first date the vehicle was registered unless agreed upon by the SBWMA. Collection 2547 vehicles and other vehicles whose acquisition costs are included in the calculation 2548 of Contractor's Compensation may be used only in the SBWMA Service Area. 2549 B. General Vehicle Specifications 2550 1. All vehicles used by Contractor in providing Solid Waste, Targeted Recyclable 2551 Material, and Organic Material Collection services shall be registered with the 2552 California Department of Motor Vehicles. 2553 2. All Collection vehicles shall have leak -proof bodies designed to prevent 2554 leakage, spillage, and/or overflow and shall be designed so that Collected 2555 materials are not visible. 2556 3. All vehicles shall comply with California Environmental Protection Agency 2557 (EPA) noise emission regulations and California Air Resources Board air 2558 quality regulations and other applicable pollution control regulations. 2559 4. All Collection vehicles shall have cameras to monitor driving and loading 2560 activities including, at a minimum: (i) back-up cameras mounted at the rear and 2561 side of the vehicle; and, (ii) a hopper camera clearly displaying the contents of 2562 the hopper prior to compaction. 2563 5. Contractor shall be required to operate an adequate number of Collection 2564 vehicles that shall be capable of servicing hard -to -service areas and accessing 2565 long driveways in the Service Area. 2566 6. All Collection vehicles shall be capable of unloading materials in the 2567 Designated Transfer and Processing Facility buildings taking clearance 2568 heights, especially in the MRF, into consideration.
