It is recommended that this tree <br /> screen be relocated closer to the recycled water tanks, to 'address potentially <br /> significant impacts to shore birds and the visual character of the area. As <br /> described on page 65 of the EIR, the open water area within the Specific Plan <br /> boundary is an important haven for migrating and shore birds. Ringing the <br /> open water area with trees may result in the loss of the area as a feeding and <br /> resting place for these birds, as well as provide additional roosting areas for <br /> predatory birds, e.g. raptors. Moving the tree screen closer to the tanks would <br /> result in the site remaining oDen and safer for birdlife. <br /> <br /> 3) Modify '14/est Tree Screen' by removing the tree element but retainingshrubs <br /> and ground cover. The Specific Plan recommends a landscape screen, which <br /> includes a tree row, along the eastern frontage of Radio Road. For the same <br /> reasons identified in Item #2 above, it.is recommended that the tree row <br /> element of the landscape plan be deleted. This would eliminate some tree <br /> cover for predatory birds, and also retain the open vistas as seen from Radio <br /> Road and the residential areas to the west. <br /> <br /> 4) Eliminate the linkage which states that the recycled water tanks can only be <br /> built upon the removal of the existing service road. The original requirement in <br /> the Specific Plan to link the recycled water tanks to removal of the existing <br /> service read was to assure that there would always be access to the water <br /> tanks. However, this assumption was inCorrect because, according to SBSA, <br /> the tanks will have access from the existing treatment plant service roads. <br /> Also to link the construction of the new recycled water tanks to the new service <br /> read might delay the tanks because of the necessary State agency approvals <br /> for the new read. The linkage between construction of the new service read to <br /> removal of the existing service road should be retained. This linkage is <br /> needed in order to provide "no net !0ss'' of open space in the buffer area, and <br /> is included in the Specific Plan. <br /> <br />EIR Letters <br />According to one of the appellants, there were four letters missing from the EIR, three <br />from homeowner associations and one from an individual. The status of those letters is <br />as follows: <br /> · A Resolution adopted on January 15, 2002, by the Gossamer Isle <br /> Association expressing concern about parking. <br /> <br /> Staff Response: This letter was incorporated in the EIR via a memo to the <br /> Planning Commission on May 1,2002, and made part of the record for the EIR <br /> certification. Although the document was not in the EIR itself, it is a part of the <br /> record. <br /> <br /> · An e-mail expressing opposition from Beacon Shores Homeowners <br /> Association. <br /> <br /> Staff Response: Staff did contact the Homeowner's Association and the <br /> gentleman who e-mailed the letter of opposition. There was no formal letter of <br /> opposition from the Beacon Shores Association. The gentleman who wrote <br /> <br /> <br />
