PLANNING ISSUES <br />Parkin.q <br />Although the final EIR has concluded that there would not be any unavoidable <br />significant impacts, there is still the concern there will not be sufficient parking for <br />the church use. (Please see Chapter 3, page 4 of the Final Environmental <br />Impact Reports which provides a very good and thorough discussion of the <br />parking issues). <br /> <br />The EIR recommended a very conservative parking requirement for the church <br />use (284 spaces) versus the Zoning Code requirement (202 spaces). Fully Alive <br />Community Church plans to fulfill this higher parking provision by entering into a <br />parking agreement with "The Pointe" office complex across the street. According <br />to the Church and the office owner, an agreement can be made for up to 300 <br />parking stalls, if needed3. <br /> <br />A recorded grant of easement for the parking use will be required per the <br />Specific Plan and ultimately the Use Permit. It will run with the title to the office <br />complex. The easement will continue indefinitely unless rescinded by the owner <br />of The Pointe property by notification to the owner of the Church property and <br />the City, at least two years before the date of rescission. <br /> <br />Some community representatives believe that there will be a parking spillover on <br />nearby residential streets. The EIR points out that parking spillover on Radio <br />Road and residential streets "...is not anticipated due to the limited number of <br />spaces available and existing parking restrictions on those streets. Nearby <br />residential streets do not accommodate street parking, except for occasional <br />cutouts with a limited number of spaces." <br /> <br /> Enforcement of Use Permit Conditions <br /> The Redwood Shores Bayfront Specific Plan recommends that the Use Permit <br /> should be revoked if there is not sufficient parking. This policy is consistent with <br /> the Zoning Ordinance, Section 42.8, which states that a Use Permit may be <br /> revoked if any of the conditions of a Use Permit cannot be met. The Use Permit <br /> will be enforced by the City and will be based on a complaint bases and <br /> subsequent follow up investigations by the City. Any changes to the conditions <br /> or parking situation will require public hearings and an amendment to the <br /> Specific Plan. <br /> <br /> RECOMMENDATION <br /> Staff recommends that the Planning Commission: <br /> <br /> 1. Certify the Environmental Impact Report by making the findings required by <br /> CEQA <br />2. Recommend Approval of the Specific Plan to the City Council <br /> <br /> 3 The Zoning Ordinance allows the Zoning Administrator to permit the location of all or part of the <br /> required parking spaces on non-adjacent parcels located within 400 feet of the premises to which <br /> the parking requirement pertains. The Zoning Administrator has permitted offsite parking for <br /> churches elsewhere in the City. Please see memo dated March 19, 2002, in Appendix B of the <br /> Final Environmental Impact Report. <br /> <br /> <br />
