<br />7A <br />age 2 <br /> <br />REPORT <br /> <br />To the Honorable Mayor and City Council <br />From the Ci Mana er <br /> <br />February 13, 2006 <br /> <br />Subject <br />City staff has prepared a Draft Lagoon Bank Policy ("Policy") with the intent of setting forth <br />some construction guidelines for waterfront properties on the Redwood Shores Lagoon <br />("lagoon"). The purpose of the Policy is to maintain the integrity of the lagoon slope, assist <br />in the maintenance of a clean water way, protect the public health and safety of Redwood <br />Shores residents, as well as to preserve the aesthetic quality of the lagoon and <br />surrounding neighborhoods. <br /> <br />In support ofthe Policy, City staff has conducted a Waterfront Inventory to identify the level <br />of conformity (or nonconformity) of existing construction on the Redwood Shores Lagoon <br />Bank and then has categorized the nonconforming improvements / waterfront properties <br />into several levels of significance (Le., Level 3 and Level 1, defined below)2. These <br />categories work to identify which waterfront improvements represent a potential concern to <br />the public health and safety and the overall stability of the Redwood Shores Lagoon Bank. <br /> <br />Recommendation <br />Staff requests that the City Council review and comment on the Redwood Shores Lagoon <br />Bank Policy & Construction Guidelines as recommended by the Planning Commission at <br />their June 21, 2005 and September 20, 2005 meetings. Furthermore, staff requests <br />consideration of the removal and/or modification of existing improvements that have been <br />classified with "Level 3" significance3 and recommends that those properties that have <br />been identified with "Level 1" significance4 as outline in the Waterfront Inventory be <br />"grandfathered"; thereby allowing these properties to retain their improvements upon the <br />recordation of an Encroachment Permit. <br /> <br />Background <br />Over the past two years, City staff has conducted a number of individual site visits with <br />waterfront property owners, held several meetings forthe community associations and for <br />the Redwood Shores community as a whole. The combined effort has helped shape the <br />Policy, although not all the stakeholders (Le. waterfront property owners) agree on the <br />method of implementation. <br /> <br />These meeting dates were as follows: <br />. November 2002 - January 2006, Individual site visits. <br />. June 2004, Redwood Shores Owners Association (RSOA) Board Meeting. <br />. July 2004, Redwood Shores Community Association (RSCA) Board Meeting. <br /> <br />2 Properties identified with level 2 Significance were re-classified into Level 3 or Level 1 per the Planning <br />Commission. <br />3 level 3 Significance - represented the properties with waterfront improvements that have life safety <br />issues or potentially significant structural issues. <br />4 level 1 Significance - properties with waterfront improvements that have a minor potential to <br />compromise the integrity of the lagoon bank. <br /> <br />-~'-'"""n...n"","-,,- <br /> <br />.._0-__".. .n" ' -------,_.__.__._'--"'--"~' <br />
