Relative to the jurisdiction of the cCouncil, board or commission, no member thereof <br />shall attempt to unduly influence or intervene in the cCity mManager’s, administrative officer’s, <br />or department director’s exercise of supervision or control of any subordinate employee. <br /> <br />2. The foregoing shall not preclude any member of the cCouncil, or any board or commission <br />from consulting with any cCity administrative officer or employee for informational purposes. <br /> <br />3. Any violation of the foregoing provisions of this section shall constitute a misdemeanor and <br />shall work a forfeiture of the office of the offending member of the cCouncil, board or commission, <br />who may be removed therefrom by the cCouncil or by any court of competent jurisdiction. <br /> <br />No persons related by blood or marriage to the cCity mManager, cCity officer or department <br />director having appointment authority, shall be eligible for employment. CITY ENGINEER: <br /> <br />City Engineer shall perform such duties as may be prescribed by law for a city engineer and shall <br />also be sStreet sSuperintendent, until such time as the cCouncil may direct a separate officer to <br />act as sStreet sSuperintendent. <br /> <br />The City Engineer shall be the custodian of, and responsible for, all maps, plans, profiles, field <br />notes, and other records, and memoranda belonging to the cCity, pertaining to his or her their <br />office and the work thereof, all of which he or she they shall keep in proper order and condition, <br />with full indices thereof. <br /> <br />The City Engineer shall turn the same over to his or her their successor upon relinquishing his or <br />her their office, who shall give him or her them duplicate receipts thereof, one of which he or she <br />they shall file with the City Clerk. All maps, plans, profiles, field notes, estimates and other <br />memoranda of surveys and other professional work made or done by him or her them or under <br />his or her their direction or control as City Engineer during his or her their term of office shall be <br />the property of the cCity. <br /> <br />The City Engineer shall, at the time of his or her their appointment, have been a practicing <br />engineer for a period of at least three years. All other things being equal, an engineer who has had <br />special training or experience in municipal engineering shall be appointed to this office, if <br />practicable. <br /> <br />The sStreet sSuperintendent shall perform such duties as may be prescribed now or hereafter, by <br />ordinance or general laws of the sState. Nothing herein contained shall prevent the cCity <br />mManager from acting as ex-officio City Engineer and sStreet sSuperintendent and filling such <br />offices as herein provided.
