<br />7.3 <br /> <br />7.4 <br /> <br />7.5 <br /> <br />7.6 <br /> <br />8 <br /> <br />For purposes of this paragraph, Fiber Network Activation shall mean that all the <br />necessary equipment to activate the Fiber Network Site has been installed and <br />tested in accordance with Section 7.3, below, by Grantee, excluding the <br />installation and Activation of any end user equipment required to utilize the Fiber <br />Network. <br /> <br />Fiber Network Testing/Certification. All Fiber Network Optics installed either <br />on an incremental build or separate build will have OTDR testing performed, and <br />OTDR printouts will be included in the final documentation package to certify <br />that a Fiber Network Site is deemed activated. Specifically, the Fiber Network <br />Optics will be tested for end-to-end attenuation at both 131 Onm and 1550nm, <br />using an optical power source and optical power meter. Tests will be performed <br />after the connectors have been installed and will be from the jumper side of the <br />termination panel bulkhead connector, at the Fiber Optic origination point and <br />through and to the jumper side of the bulkhead connectors at each Fiber Network <br />location's Demarcation Point Fiber Optic termination panel. Maximum loss will <br />not exceed manufacturers' passive cable system attenuation, adjusted for cable <br />length, splice loss (maximum loss per splice is .2dB) and connector loss. The <br />maximum connector pair loss is assumed to be .5dB. <br /> <br />If the City's Fiber Network Site connectors are not installed in a timely fashion, <br />the Grantee shall test the continuity of the fiber without the connectors and the <br />Site shall be deemed completed. <br /> <br />Construction Credit Declining Balance. <br /> <br />(a) <br /> <br />Grantee shall provide to the City, on a quarterly basis, the assessments <br />made against the City's Construction Credits for Fiber Network <br />construction. <br /> <br />(b) <br /> <br />Any changes to the initial construction location after initial installation <br />will be charged to the City at the Grantee's time and material costs. An <br />estimate for such costs will be provided to the City within sixty (60) days <br />of a written request. <br /> <br />(c) <br /> <br />If the City requests relocation of any portion of the Grantee's Fiber <br />Network in accordance with a State of California Rule 20 relocation <br />request, the City shall pay the prorated cost for splicing the Fiber Network. <br /> <br />Alternative Procedures. Nothing in this Agreement shall be read to prevent the <br />parties from agreeing to different procedures for Fiber Network construction, as <br />long as those procedures (a) permit the Fiber Network to be constructed <br />efficiently and cost-effectively and (b) are incorporated in a written document <br />which is executed by each of the parties hereto. <br />
