6.13. - Page 82 of 366 <br />Chiefs in cases where sick leave balances were decreased due to reassignment <br />from a fifty-six (56) hour to a forty (40) hour work week. <br />16.1.5 An employee may elect to receive compensation in lieu of sick leave credits for <br />any calendar year (based on the first twenty-six 261 pay periods ending thatin <br />the calendar year) by requesting payment of unused sick leave in writing to the <br />Director of Finance on or before December 1 of the prior year. <br />Payment shall be made at twenty-five (25%) of the value toe unused sick <br />leave hours accrued in the calendar year, <br />Payment shall be made atm fifty percent (50%) of the 1elti unused sick <br />leave hours accrued in the calendar year when no more than ten (10) hours of <br />sick leave have been used (twenty-four 241 hours for Shift Battalion Chiefs) in <br />the first. twenty-six (26) pay periods, fen the prnseding year at the <br />door in Whieh the payment is being made (Battalion Chiefs assigned to a 40 - <br />hour schedule shall have leave paid out at the corresponding 56 -hour rate). <br />Payment shall be made after December 31. There shall be no payment in lieu of <br />accumulated sick leave benefits for years prior to such calendar year. Use of <br />Personal Business Leave shall be excluded from the definition of sick leave for <br />the purposes of this section. <br />16.1.& Accumulated sick leave credits shall be reduced by the value of the sick leave <br />compensated as provided in the above paragraph and the remaining balance <br />shall be accumulated to a maximum of one -thousand two -hundred (1200) hours <br />(two -thousand four hundred (2,4001 hours for Battalion Chiefs who work a fifty- <br />six (56) hour work week). <br />16.1.7 If an employee terminates his or her employment, for reasons other than death, <br />retirement or discharge, compensation in lieu of unused sick leave shall be paid <br />in the amount provided for an employee who ff* <br />elects to receive compensation in lieu of sick leave credits in accordance with <br />Section 16.1.5, prorated to the date of termination of service. <br />.Employees who have ten (10) years of service and who retire from City <br />employment with benefits from CalPERS or who die while in the employ of the <br />City shall be eligible to receive, ) nmmpnnsatinn in lien of UnUSP-d- in Deer rria nen <br />iR lieu of sick leave gredifs prorated to the ante of fern. Sick leave converted to CalPERS service credit shall not be <br />subject to this Section. <br />In the event of the death of an employee, such payments shall be made to the <br />designated beneficiary filed with the Director of Finance, or, in the event no <br />designated beneficiary has been chosen, the beneficiary listed in the employee's <br />insurance policy.
