6.B. - Page 135 of 366 <br />TENTATIVE AGREEMENT BETWEEN CITY OF REDWOOD CITY <br />AND REDWOOD CITY POLICE SUPERVISORS ASSOCIATION (RCPSA) <br />RE: 2018 SUCCESSOR MOU NEGOTIATIONS <br />statement by the Police Chief as to the resigned employee's service performance and other pertinent <br />information concerning the cause for resignation. <br />SECTION 13. LAYOFF <br />13.1 Reassignment of Effected Employee <br />13.1.1 A sworn Police Sergeant, who has received a notice of layoff, may elect, in lieu of <br />layoff, to be reassigned to the rank of Police Officer, provided that in order to <br />displace the Police Officer the Police Sergeant was promoted from the rank of <br />Police Officer directly from the Redwood City POA. The Police Sergeant who <br />elects to be reassigned can only displace an employee with less department <br />seniority than the Police Sergeant exercising reassignment rights. <br />A sworn Police Lieutenant, who has received a notice of layoff, may elect, in lieu <br />of layoff, to be reassigned to the rank of Police Sergeant, provided that the <br />Lieutenant was promoted from the rank of Police Sergeant, The Police Lieutenant <br />who elects to be reassigned can only displace an employee with less seniority <br />within the RCPSA unit than the Police Lieutenant exercising his or her rights. <br />13.1.2 An employee requesting to exercise the right to be reassigned into a previously <br />held, lower -rank position, must make such a request to the Personnel Officer in <br />writing within seven (7) calendar days of the receipt of the written notice of layoff. <br />Failure to comply with the deadline provided herein shall be deemed a waiver of <br />the reassignment rights provided in RCPSA MOU Section 13. <br />13.1.3 When an employee chooses to be reassigned to a lower rank position, the employee <br />will maintain his/her seniority within the department. The employee must also <br />accept the salary, hour and working conditions of the lower rank position. If the <br />salary of the employee is within the salary range of the lower rank classification, <br />the employee will be placed at the step of the lower rank classification range that <br />is closest to, but no less than, the salary received in the position held at the time of <br />the layoff notification. If the employee's salary prior to the reassignment is above <br />the top of the range of the lower rank position, the employee's salary will be placed <br />at the top of the salary range for the lower rank classification effective the first date <br />of the reassignment. <br />13.1.4 An employee who elects to be reassigned to a lower rank position will not serve a <br />probationary period in the lower rank position upon reassignment and will retain <br />regular employment status with the City of Redwood City. <br />13.2 Order of Reassignment to the Classification of Sergeant <br />An employee who is reassigned to a lower rank position due to a reduction in force shall <br />be placed, for a period of three (3) years from the date of the employee's reduction in rank, <br />on a promotion list for the position previously held. In promoting for a vacant position, <br />such a promotion list shall take precedence over all other employment lists and the last <br />employee reduced in rank shall be the first employee promoted until the list is exhausted. <br />34 <br />
