6.B. - Page 161 of 366 <br />accordance with the requirements of the City; to establish and change work schedules and <br />assignments; to lay off employees for lack of work; to expand or diminish services; to <br />subcontract any work or operations; to determine and change methods of operations; to <br />determine and change work locations and the processes and materials to be employed; to <br />take all necessary actions to perform its functions in emergencies. <br />SECTION 5. ASSOCIATION REPRESENTATIVES <br />City employees who are official representatives or unit representatives of the Association <br />shall be given reasonable time off with pay to attend meetings with management <br />representatives, labor conferences, labor training seminars, or to be present at hearings <br />where matters within the scope of representation or grievances are being considered. The <br />use of official time for this purpose shall be reasonable and shall not interfere with the <br />performance of City services as determined by the City Personnel Officer. Such <br />Employee representatives shall submit a written request for excused absence to the Police <br />Department Head or his or her designated representative with an information copy to the <br />City Manager, at least two (2) weeks prior to the scheduled meeting, labor conference, or <br />labor training seminar whenever possible. Except by mutual agreement, the number of <br />employees excused for such purposes shall not exceed two (2) contingent upon minimum <br />staffing requirements. The affected shift supervisor will post any necessary overtime to <br />backfill their respective shift; however, if there are no takers for the overtime, no officer <br />will be compelled to work overtime and permission will not be granted for the requested <br />absence. It is incumbent on the association representative who is attending the meeting, <br />labor conference or labor training seminar to check with the affected shift supervisor to <br />ensure that in the event any overtime is needed, it is posted and filled. <br />SECTION 6. NO STRIKE <br />The Association, its members and representatives, agree that it and they will not engage <br />in, authorize, sanction, or support any strike, slowdown, stoppage of work, curtailment of <br />production, concerted refusal of overtime work, refusal to operate designated equipment <br />(provided such equipment is safe and sound) or to perform customary duties; and neither <br />the Association nor any representatives thereof shall engage in job action for the purpose <br />of effecting changes in the directives or decisions of management of the City, not to <br />effect a change of personnel or operations of management or of employees not covered <br />by this MOU. <br />SECTION 7. PAY <br />1 7.1 Salary Increases <br />7.1.1 Effective October 29 2018 em to ees represented by the Association <br />shall receive a two and one-half percent (2.5%) cost of living adjustment. <br />i :l <br />
