REV: 07-15-2021 VR <br />Deliverable <br />Screencheck Draft EIR (electronic) <br />Draft EIR (electronic for City website and electronic submittal to State <br />Clearinghouse) <br />Administrative Draft MMRP (electronic) <br />Draft MMRP (electronic) <br />Final MMRP (electronic) <br />Screencheck Final EIR and Final EIR <br />Consultant will revise the Administrative Final EIR by incorporating written responses to <br />comments received from City staff, yielding a Screencheck Final EIR and then the Final EIR <br />review. One set of unified comments incorporating all City staff comments on the Draft and <br />Screencheck Final EIRs will be provided to Consultant. The Final EIR shall comprise the Draft <br />EIR, comments on the Draft EIR, and responses to all comments on the Draft EIR, including any <br />necessary changes to the Draft EIR text. Submittal of the Final EIR shall be accompanied by <br />submittal of the Final MMRP, as outlined below. Consultant will present the Final EIR and MMRP <br />to the Planning Commission and City Council for certification at a public hearing (as detailed in <br />Task 7A). <br />Deliverable <br />Administrative Final EIR including response to comments (electronic) <br />Screencheck Final EIR including response to comments (electronic) <br />Final EIR including response to comments (electronic, electronic submittal to <br />State Clearinghouse) <br />Task 6A: Noticing <br />Consultant will prepare all CEQA-required notices in compliance with state legislation and <br />guidelines. This task includes the preparation of the Notice of Availability (NOA) and the Notice <br />of Completion (NOC). Consultant will prepare a NOA for both the Draft EIR and Final EIR. This <br />task includes completing the NOA form, as well as preparation of the associated mailings and <br />newspaper notices electronic files for City printing, envelope stuffing, and distribution. Consultant <br />will prepare the NOC in compliance with the CEQA Guidelines and submit the draft notices for <br />City staff review; if necessary, Consultant will revise the draft notices based on staff comments. <br />Consultant will file one copy of the NOC with the State Clearinghouse at the time of Draft EIR <br />publication. <br />Consultant will prepare and file the Notice of Determination (NOD) with the San Mateo County <br />Clerk within five business days of EIR certification. The purpose of the NOD filing is to limit the <br />legal challenge period to 30 days. If an NOD is not filed within five business days of certification, <br />the legal challenge period is 180 days. The NOD filing also requires payment of a filing fee, which <br />Consultant assumes will be paid by the City. <br />Findings of Fact <br />The City will prepare written findings for each significant effect identified in the EIR as a separate <br />document, pursuant to CEQA Guidelines Section 15091. If requested, Consultant will prepare <br />Findings of Fact on behalf of the City. As required by the State CEQA Guidelines, one of three <br />findings must be made for each significant effect, which must be supported by substantial <br />evidence in the record.
