6.E. - Page 2 of 26 <br />habitat as well as serve as stormwater detention for the Bayfront Canal and Atherton Channel drainage <br />areas, which will increase flood protection for the whole watershed. <br />The City agreed to apply for the DWR funding through an application submitted by the Association of <br />Bay Area Governments (ABAG) and San Francisco Estuary Partnership (SFEP) for the BC/AC Project. <br />ABAG's application was successful and ABAG was awarded an IRWM Grant in the amount of $20 Million <br />on February 14, 2014. <br />On June 26, 2017, the City Council authorized the City Manager to execute the Local Project Sponsor <br />agreement (LPS Agreement), which was executed by all parties. <br />ANALYSIS <br />The City is working closely with the City of Menlo Park, County of San Mateo, Town of Atherton, Town of <br />Woodside, Coastal Conservancy and other partners to develop improvements to prevent flooding along <br />the Bayfront Canal and Atherton Channel. The LPS Agreement does not obligate the City to construct <br />improvements for the Bayfront Canal or Atherton Channel, but allows the City to seek cost <br />reimbursement when the City proceeds with construction. The LPS Agreement will allow the City to <br />submit invoices to ABAG/SFEP, which in turn, will submit to DWR for reimbursement the costs incurred <br />for construction of the BC/AC Project. <br />The LPS Agreement has a reimbursable cost limit of $1,135,000 with a deadline of December 31, 2018 to <br />incur and submit costs. Amendment No. 1 extends the date that City -incurred costs would be eligible for <br />reimbursement by another two years to December 31, 2020. Furthermore Amendment No. 1 increased <br />the amount that could be eligible for reimbursement by an additional $103,000 for a total reimbursable <br />amount of $1,238,000. <br />Currently staff are in the process of obtaining regulatory permits and designing the BC/AC Project. It is <br />necessary to execute the amendment to the LPS agreement to obtain the additional time and funding to <br />implement and complete the project. <br />FISCAL IMPACT <br />As of December 11, 2018, the Capital Outlay Fund has an available budget of $5,097,701 for Bayfront <br />Watershed Management and Habitat Restoration. The Proposition 84 grant funding available through <br />the LPS Agreement would reimburse the City for costs incurred on the BC/AC Project, up to an amount <br />of $1,235,000. The total cost for the BC/AC Project has not been finalized and additional funding sources <br />from grants and contributions from other agencies are being pursued. <br />ENVIRONMENTAL REVIEW <br />This activity is not a project under California Environmental Quality Act (CEQA) as defined in CEQA <br />Guidelines, section 15378, because it has no potential for resulting in either a direct or reasonably <br />foreseeable indirect physical change in the environment.
