<br />requirements of Chapter 9 of this Code (including all codes <br /> <br /> <br />adopted there in by reference) and as such provisions may <br /> <br /> <br />be amended. <br /> <br />"All such determinations shall be for purposes of <br /> <br /> <br />clarification and shall be of uniform application throughout <br /> <br /> <br />the City and shall not operate to create an exception from <br /> <br />any provision of this Code, other ordinances of the City <br /> <br /> <br />or state law. <br /> <br /> <br />"Section 2.126 (a) Any person who is denied a <br /> <br /> <br />building permit for the reason that the material or type <br /> <br /> <br />of construction, intended to be used is not deemed to be <br /> <br /> <br />in compliance with the provisions of Chapter 9 of this Code <br /> <br /> <br />by the Building Inspector, and any person who is denied an <br /> <br /> <br />inspection approval or a temporary or final certificate of <br /> <br /> <br />occupancy for the reason that the material used or type of <br /> <br /> <br />construction employed is not deemed to be in compliance <br /> <br />with the provisions of such provisi.ons by the Building <br /> <br /> <br />Inspector, may appeal to the Board of Building Review. <br /> <br /> <br />"(b) Every appeal, as provided by the preceding section, <br /> <br /> <br />shall be in writing on forms approved by the Board of Building <br /> <br /> <br />Review and furnished by the Building Inspector. Every such <br /> <br /> <br />appeal shall be filed with the Building Inspector at least <br /> <br /> <br />ten days prior to being considered by the Board. Every <br /> <br />such appeal shall indicate the Code provision or provisions <br /> <br /> <br />concerned, the nature of the appeal, the type of material <br /> <br /> <br />or construction intended to be used, and shall be accompanied <br /> <br /> <br />by such drawings, plans, information or other materials <br /> <br />dee~~d appropriate by the Board. <br /> <br /> <br />"(c) The appellant or any other interested person may <br /> <br />submit, in writing, his comments and recolMlendations concerning <br /> <br />-31- <br /> <br />... <br />
