<br />5. INSURANCE. Permi ttee shall furni sh to the City pub 1 i c <br />liability and property damage insurance naming the City <br />of Redwood City, its Council, boards, commissions, officers, <br />en~loyees and agents as insureds, or additional insureds, <br />insur'ing the same against all claims for personal injury <br />or death to any person or persons resulting or arising from <br />the conducting of the activities herein described, or from <br />any act or omission of PenniUee in connection therewith, <br />in the amounts of $1,000,000 for each person and $1,000,000 <br />for each occurrence. and property damage or injury to or <br />destruction of property, including the loss of use thereof, <br />in the amount of $500,000. Additionally, Butler Amusement <br />Inc., shall name the City an additional insured on their <br />$3,000,000 liability policy. Evidence of the insurance <br />required hereunder, in fonn satisfactory to the City shall <br />be furnished by Permittee to the City prior to the commence- <br />ment of said Carnival. <br /> <br />6. U/\MAGE TO PUBLIC PROPERTY. 1 t is understood and agreed <br />that Pennittee shall be responsible for and shall reimburse <br />the City for the costs of any damages to or suffered by <br />CHy--owned property arising out of the conducting of the <br />Carnival permitted hereunder. <br /> <br />7. COMPLJANCE WIlli lAWS. Penni ttee shall comp Iy with all <br />appropriate ru'les, regulat"ions, and laws applicable to <br />ar~ and all activities which are part of or associated <br />said Carnival. This pennit shall be in addition to all <br />other permits which are or may be required for conducting <br />said Carnival, or any activity associated therewith. <br />Specifically, Permittee shall obtain necessary State, <br />permits and County health permits. <br /> <br />8. 1I0LD IIARMLESS. Permittee shall assume the defense of and <br />indemnify and save hannless the City of Redwood City, its <br />Council, officers, boards, commissions, employees and agents <br />from all suits, actions, damages or claims to which the City <br />may be subjected of any kind or nature whatsoever resulting <br />from or arising out of the performance or failure to perform <br />of Pe)~ittee hereunder, or otherwise resulting from or arising <br />out of said Carnival and the activities herein pennitted. <br /> <br />11243 <br />
