<br />DES:d~ 01/17/90 (014/39) <br /> <br />Permittee in, upon or over the Subject Premises for the purpose <br /> <br /> <br />of facilitating City's use of adjoining spaces or areas within <br /> <br /> <br />the general area described as the Subject Premises. In the event <br /> <br /> <br />City requests Permittee to so relocate its property, and <br /> <br />Permittee fails or refuses to do so, City may do so at <br /> <br /> <br />Permittee's cost and expense. In such event, City may relocate <br /> <br />said equipment or property to another area within the general <br /> <br />area designated as the Subject Premises. <br /> <br /> <br />4. IMPROVEMENTS. Permittee shall not make, nor cause to <br /> <br /> <br />be made, nor allow to be made, alterations or improvements to the <br /> <br />Subject Premises (including the installation of any fixture <br /> <br /> <br />affixed to the Subject Premises) without the prior written <br /> <br />consent of City's City Manager. All improvements or alterations <br /> <br /> <br />constructed or installed shall be removed and the Subject <br /> <br /> <br />Premises restored to substantially the same condition existing <br /> <br />prior to such construction or installation, upon the termination <br /> <br />hereof unless the prior written approval of City's City Manager <br /> <br /> <br />is secured allowing such improvements or alterations to remain in <br /> <br />place, in which case, title thereto shall vest in City. <br /> <br /> <br />5. SIGNS. Permittee shall not construct, place, nor erect <br /> <br /> <br />any signs in, upon or over the Subject Premises without the prior <br /> <br />written consent of City's City Manager. <br /> <br /> <br />6. WAIVER OF CLAIMS. City assumes no responsibility for <br /> <br /> <br />the guarding and safekeeping of property, equipment, or <br /> <br />improvements installed or constructed by Permittee upon, or used <br /> <br /> <br />in connection with, the Subject Premises. Permittee hereby <br />waives all claims against City, and agrees to hold City harmless <br />from any claims, for damages to materials, supplies, equipment or <br />3 <br /> <br />11213 <br />
