<br />DES:d~' 01/17/90 <br /> <br />(014/39) <br /> <br />failure to act, in the occupancy, maintenance, operation or use <br /> <br />of the Subject Premises, and Permittee hereby agrees to pay and <br /> <br /> <br />discharge all costs, charges and expenses (including, without <br /> <br /> <br />limitation, attorneys fees and costs of suit) that may be <br /> <br />incurred in connection therewith and any and all judgments that <br /> <br /> <br />may be rendered by reason thereof. <br /> <br />9. COMPLIANCE WITH LAWS. Permittee shall comply with all <br /> <br /> <br />laws concerning use and occupancy of the Subject Premises <br /> <br />including, without limitation, the obligation at Permittee's cost <br /> <br /> <br />to maintain or restore the Subject Premises, or the equipment <br /> <br /> <br />stored thereon, in compliance with, and in conformance to, any <br /> <br />and all laws relating to the condition, use, or occupancy of the <br /> <br /> <br />Subject Premises or the storage and use of said equipment. <br /> <br />10. CONDITION OF PREMISES. Permittee shall, at its own <br /> <br /> <br />cost and expense, keep and maintain the Subject Premises, <br /> <br /> <br />including any equipment placed or stored thereon, in reasonable <br /> <br />order and repair, and shall keep all portions of the Subject <br /> <br /> <br />Premises clean, neat, orderly and free of papers, debris, wastes, <br /> <br />or other articles or things which increase the danger of fire or <br /> <br /> <br />detract from the aesthetic appearance of the Subject Premises. <br /> <br /> <br />Permittee shall, at its own cost and expense, conduct all <br /> <br /> <br />operations on, and use of, the Subject Premises in such manner as <br /> <br />to avoid discharging dust, solids, fumes, odors, gases, or <br /> <br />liquids into or on the Subject Premises, or otherwise into the <br /> <br /> <br />environment so as to pollute the same. permi ttee shall not <br /> <br /> <br />bring, place, or store upon the Subject Premises any hazardous <br />wastes or material or other such thing or substance, except such <br />fuel, oil, or other petroleum products necessarily required for <br />5 <br /> <br />11213 <br />
