non-compliance which shall specify th~ particulars of such <br />non-compliance and shall require the~ Owner to remedy the <br />non- compl i an ce. <br /> <br />If the Owner fails to remedy the non-ccmD iance, the Board shall, <br />after thirty (30) days from the date ~ notification of non- <br />compliance, provide notice and hearing zo consider the Owner's <br />continuing non-compliance. At the hearing, if the Board finds that <br />there is no valid reason for the continuing non-compliance: the <br />Board shall determine the estimated costs of correcting it. <br /> <br />The Board shall then require the Owner to i'r=.medy or remove the same <br />within a period of not more than forty-five (45) d_sys from the date <br />of the Board's determination. If the O.~ner does not comply with <br />the Board's ruling within such period, the Board may either remove <br />the non-complying improvement or remedy'~the non-compliance. The <br />costs of such action shall be assessec~ ~gainst the Owner as a <br />Reimbursement Charge pursuant to Article%% of this Declaration. <br /> <br />Section 2 Appointment. Removal and Term of Office: Declarant shall <br />appoint all replacements to the Archite~ ural Control Committee <br />until the second anniversary of the first c rose of escrow of a Lot <br />within the project. Vacancies on the Architectural Control <br />Com~ttee, however caused, shall be filled )y the Declarant or the <br />Board, whichever then has the power to apFoint members. <br /> <br />Section 3 Duties: It shall be the du~ of the Architectural <br />Control Co~m~,4ttee to consider and act upon~uch proposals or plans <br />submitted to it pursuant to the terms cfi Section 5 hereof, to <br />adopt Architectural Control Committee R~les, to perform other <br />duties delegated to it by the Association[ and to carry out all <br />other duties imposed upon it by this Decla~ation. <br /> <br />Section 4 Meetings: The Architectural (:ontrol Committee shall <br />meet from time to time as necessary to prop-=rly perform its duties <br />hereunder. The vote or written consent ~f any majority of the <br />Committee shall constitute an act by th,. Committee unless the <br />unanimous decision of its members is othe] wise required by this <br />Declaration. The Committee shall keep and ~ ~intain a record of all <br />actions taken by it at such meeting or otherwise. The <br />Architectural Committee and its members shall be entitled to <br />reimbursement for reasonable out-of-pocket ~ cpenses incurred in the <br />performance of any Architectural Control C~)mmittee function. <br /> <br />Section 5 Applic~tiQn fQr ApprQv~l of Impro~ements: Any Lot Owner, <br />except Declarant and its designated agents proposing to perform <br />any work of any kind whatever which require: the prior approval of <br /> <br /> 33 <br /> <br /> <br />
