Permittee further acknowledges and agrees <br /> <br /> <br />that in the event of removal, damage, destruction or otherwise <br /> <br />altering of the condition of said fence, bus shelter, and <br /> <br /> <br />sidewalk canopies by third parties, Permittee shall reconstruct, <br /> <br /> <br />reinstall, and repair said fence, bus shelter, and sidewalk <br /> <br /> <br />canopies at its own cost and expense upon request of City so to <br /> <br />do. <br /> <br />In the event the City, its agents, employees, contractors or <br /> <br /> <br />subcontractors damage or otherwise alter the conditions of the <br /> <br /> <br />said fence, bus shelter, and sidewalk canopies or any portion <br /> <br />thereof, in connection with the ownership and use of City-owned <br /> <br /> <br />real property adjacent to and abutting the subject premises <br /> <br /> <br />permi ttee shall promptly reconstruct, reinstall or repair said <br /> <br />fence, bus shelter, and sidewalk canopies and shall bear all <br /> <br /> <br />costs and expense of the reconstruction, reinstallation, and <br /> <br /> <br />repair. <br /> <br />7. Permi ttee' s Obligation of Removal. permi ttee shall, <br /> <br /> <br />upon receipt of notice so to do, and within such time limit as <br /> <br />may be fixed by said notice, alter, remove or relocate at the <br /> <br />expense of Permittee the said fence, bus shelter, and sidewalk <br /> <br /> <br />canopies or any portion thereof to such extent as may be <br /> <br />necessary, in City's opinion, to avoid interference with any <br /> <br /> <br />pipe, street, or utility facility or other structure or use now <br /> <br /> <br />or hereafter to be constructed by the City, or with any <br /> <br />3 <br />
