The parties acknowledge that use <br />of City's and/or Authority's respective Sewerage Facilities by Woodside is expressly <br />conditioned upon the enactment, implementation, and enforcement of said Uniform <br />Sanitary Sewerage Ordinance. <br /> <br />XI. INSPECTION SERVICES: ENFORCEMENT <br /> <br />Woodside shall provide appropriate and adequate inspection services within <br />Woodside's Service Area for the duration of this Agreement, which services shall include, <br />but not necessarily be limited to, enforcement of the provisions of the Uniform Sanitary <br />Sewerage Ordinance effective within Woodside's Service Area. Such enforcement, <br />expressly including but not limited to, enforcement of the provisions of said Ordinance <br />pertaining to pre-treatment programs which may be required thereunder within Woodside's <br />Service Area, shall be, and hereby is, delegated to Authority provided, however, that upon <br />the concurrence of Authority, the responsibility for enforcement may be delegated to City <br />or may be assumed by Woodside, as Authority shall specify. Woodside shall compensate <br />Authority or City, as the case may be, for all costs and expenses incurred by Authority or <br />City, respectively, in providing such enforcement. Subject to the foregoing concurrence <br />of Authority, should Woodside assume responsibility for the enforcement of said <br />Ordinance, any failure by Woodside so to enforce it, shall constitute a material breach of <br />this Agreement by Woodside. <br />XII. REGULATIONS. <br />Woodside shall, and hereby agrees to, comply with all rules and regulations <br />enacted or approved by Authority and/or City pertaining to the use of Authority's Treatment <br />Plant and City's and/or Authority's Sewerage Facilities (defined as "City's and/or <br /> <br />RWCfNDSIFak Oaka Agreement <br /> <br />12 <br />
