Woodside shall pay City Retroactive Fees <br />as described in Exhibit 0 attached hereto and incorporated by this reference. Payment <br />shall be made within 30 days of the execution of this Agreement. <br />VI. ACQUISITION OF ADDITIONAL SANITARY TREATMENT SEWAGE CAPACITY. <br />Subject to City acquiring additional sanitary sewage treatment capacity ("ASST <br />Capacity") from Authority for Woodside, and subject to availability of capacity from <br />Authority, Woodside may to acquire ASST Capacity from Authority through City. Upon <br />demand (the "Acquisition Date"), Woodside will deposit with City the a sum sufficient to <br />acquire an Annualized Daily Average Flow of 100,000 gallons per day (gpd) of treatment <br />capacity at a cost based upon the rate of the Authority in effect on the Acquisition Date <br />at the time said capacity is acquired. Upon acquisition of a minimum additional sanitary <br />sewage treatment capacity of an Annualized Daily Average Flow of 100,000 gpd, from <br />Authority, City shall grant to Woodside an Annualized Daily Average Flow of 100,000 <br />gallons per day of treatment capacity and rights in the following amounts: 100,000 <br />Annualized Daily Average Flow gpd, 140 Annualized Daily Average Flor Ibs/day BODS, <br />and 140 Annualized Daily Average Flow Ibs/day TSS, subject to availability from the <br />Authority. <br />VII. DISCHARGE LIMITS AND DETERMINATION OF FLOW <br />Woodside shall not discharge to Authority's Sewerage Facilities via City's Sewerage <br />Facilities, sanitary sewage exceeding an Annualized Daily Average Flow of 100,000 <br />gallons per day.
