The City may satisfy its RPO or PPD, (at any time either before or <br /> after the development of Block Two or the termination of use of the <br /> Caltrain Garage) by any one or combination of the following: <br /> i. New public parking spaces constructed by the City in the <br /> Red Zone or the Orange Zone (see attached map) that are <br /> made available long-term as free night and weekend four- <br /> hour customer parking. <br /> ii. Other parking in the Red Zone or Orange Zone, in public or <br /> private facilities, not currently (as of the date of the DDA) <br /> utilized as night and weekend parking that is made available <br /> long-term as free night and weekend four-hour customer <br /> parking. <br /> 5. Protection of Parking Spaces in Red Zone <br /> a. The parties have counted the number of publicly available parking <br /> spaces in the Red Zone and agree that it is 1,949 6(An attachment <br /> will be made to the Parking Facilities Agreement designating those <br /> spaces.) The City agrees that it will operate and maintain at least <br /> 1850' such spaces in the Red Zone or the Orange Zone. <br /> b. All new development� in the Red Zone will be required to self- <br /> park according to reasonable downtown parking standards <br /> adopted from time to time by the City. If requested by Developer <br /> ar Century, the City will promptly provide notice of all <br /> applications for new development in the Red Zone. If requested by <br /> Developer or Century, the City will create a seven-member Parking <br /> Advisory Committee (PAC) composed of a representative from <br /> Developer, a representative from Century, a representative from <br /> the Fox (if the Fox elects to participate), a City representative, and <br /> other representatives of downtown businesses or property owners <br /> as designated by the City. The PAC will advise the City Council on <br /> downtown parking issues, including: <br /> i. Downtown Parking Standards <br /> ii. The standards, criteria and findings needed for <br /> allowing variances and other exceptions to the <br /> Downtown Parking Standards <br /> 6 This number will be adjusted by the achxal construction of the Jefferson Garage and the Block 2 <br /> Parking Lot. <br /> � This number will be adjusted by the same number as Footnote 6 <br /> e Any material increase in square feet of development or a use change that would significantly <br /> increase the parking requirement. <br /> 9 A reasonable parking in-lieu payment system is allowed as a form of self-parking. <br /> Cinema Buainesa Points <br /> Page 5, 12/5/02 <br />
