Approval of detachment from the Town of Woodside and annexation to City of Redwood City {Le., change of organization} by San Mateo County Local Agency Formation Commission (LAFCo), WHEREAS. City and District are public agencies that will each carry out or approve portions of the project, and both may have a substantial daim to act as lead agency under CEQA; and WHEREAS, the District has determined that its action (approval of and funding for the Project by the District Board of Trustees) will be the first action on the Project. NOW, THEREFORE, the parties agree that the District will act as the CEQA Lead Agency for the environmental review of the Project and will have all discretion to fulfill the obligations of a CEOA Lead Agency with respect to the project. The City will act as a Responsible Agency. In accordance with Title 14 California Code of Regulations section 15051 (b), the City shall consider the District's CEOA documentation prior to acting upon or approving the portions of the Project under the City's jurisdiction. Thus, in carrying out its obligations under CEOA, the District will do the following: 1. Provide opportunity to the City to review, and comment on if appropriate, the scope of work for the CEOA consultant to be hired by the District. 2. Provide opportunity to the City to review, and comment on if appropriate, the administrative draft CEOA document prior to its issuance for the public review period . 3. Comply with the City's public noticing procedures for CEQA documents as set forth in the California Public Resources Code and the City's Municipal Code. 4. Comply with CEQA Guidelines and regulations for filing the Notice of Determination. ATTY/AGR/2007.024 061207 2
