The proposed retail warehouse project and tire center conforms to all of the <br />following criteria specified pursuant to Article 17, Section 13 of the Zoning <br />Ordinance with respect to retail sales and service uses located in the <br />Industrial Restricted Zoning District. <br /> <br />1. The proposal will not have significant adverse effects on nearby industrial <br />firms; <br /> <br />2. The tramfportation system is capable of safely supporting the proposed <br />use in addition to the existing uses in the area. Evaluation factors include <br />street capacity, and level of service, access to arterials, transit availability, <br />on-street parking impacts, access requirements, neighborhood impacts, <br />and pedestrian and bicycle safety; and <br /> <br />3. The proposed use will not significantly alter the overall balance of land <br />uses of the area, based on the existing proportion of industrial and non- <br />industrial uses and the effects of incremental changes. <br /> <br />Retail Warehouse Conditions of Approval: <br />General Conditions: <br />1. The subject use shall substantially conform to the plans, elevations and <br />related information, prepared by David Babcock and Associates, related to <br />the "Expanded Warehouse" Alternative on file with Planning Services, except <br />as modified by the conditions contained herein. <br /> <br />2. Any modifications to said approved plans, elevations and related materials <br />must be submitted to Planning Services for review and approval prior to the <br />issuance of a building permit. Failure to do so shall render this Notice of <br />Official Action null and void. <br /> <br />3. The Mitigation Monitoring and Reporting Program (MMRP) prepared for the <br />new Costco warehouse is hereby incorporated into the Use Permit approval <br />with the exception of the fair share contribution to Willow Street improvements <br />(these improvements would be required as a result of new traffic associated <br />with the gas station; additional traffic associated with the expanded <br />warehouse is relatively low and does not result in an impact on Willow Street). <br />All mitigation measures and standard conditions identified in the <br />Environmental Impact Report prepared for this project are documented in the <br />MMRP and are repeated within these Conditions of Approval. <br /> <br />4. Any significant proposed operational amendments from the approved use and <br />plans may be subject to a new Use Permit and must be submitted to Planning <br />Services for review. <br /> <br />5. In the event that any portion of the proposed retail warehouse and tire center <br />use is determined by the Zoning Administrator to have an adverse impact on <br /> <br />Page 5 of 21 <br />
