Lessee shafl be open for business and conduct full scafe <br /> aperation hereof no later than 11:40 am and c{ase no earlier than 7 prrt, <br /> everyday. <br /> 8.12 Custodial Services. Lessee will provide all custodia! services and day-ta-day <br /> clean-up for the Lease Area. <br /> 9 USE AND TIME OF USE <br /> 9.1 Unless otherwise agreed to by Lessor in writing, the Prernises may be used only <br /> by Lessee and Lessee's agents, customers, and contractors for the purposes <br /> stated herein. <br /> 9.2 Lessee agrees not to use ar permit use of the Premises for any unlawful <br /> purpose, and not to cammit or permit any waste or nuisance in ar about the <br /> Premises. Lessee will not use Premises in a manner that increases the risk of <br /> fiire, cost of fir� insurance or improvements thereon. Lessee at his/her expense, <br /> shall keep the Premises in as gaod condition as it was a# the beginning of the <br /> #erms hereof, except damage occasioned by ordinary wear and tear. <br /> 9.3 Lessee shall not do or permit to be done anything in any manner which <br /> unreasonably disturbs the other Courthouse Square lessees, their employees, <br /> customers, and visitors to the Cou�thouse Square, or the occupants of <br /> neighboring property. Specifically, and without limiting the above, Lesse� agrees <br /> not to cause any unreasonabfe odors, noise, vibration, power emissions or other <br /> item to emanate from the Premises. No materials or articies of any nature shall <br /> be stored outside any partion of the Leased area unless writfen permission is <br /> obtained from the Lessor. <br /> 10. LESSEEIMPROVEMEN7S <br /> 10.1 On the Lease Gommencemen# Date, Lessee at his ar her expense may begin to <br /> construct Lessee improvements #o the Lease Area when a building permit and all <br /> other required permits and insurance are issued, and the improvements are <br /> supervised by the Lessar or its agents. The Lessor or approved agents shall be <br /> provided fufl access to the Lease Area during the lease improvement process. <br /> Lessee shall select a qualified architect and general contractor to complete <br /> improvement of the Premises in accordance with plans and specifications <br /> approved by Lessee and Lessor ("Plans and Specifications") using only licensed <br /> contractors and in accordance with Building Cades and other government laws <br /> and regulations, including, withou# limitation, the Americans with Disabilities Ac# <br /> ("ADA"}. <br /> 10.2 Lessee shal! pay, when due, all claims for fabor or materiais furnished or alleged <br /> to have been furnished to or for Lessee, at or for use in the Premises, which <br /> claims are or may be secured by any mechanics' or material men's fiens against <br /> the Premises or any inferest therein. Lessee shafl give �essor not fewer than ten <br /> {10} days` notice prior to the commencement of any work in the Premises, and <br /> Lessor shall have fhe right to post natices of non-responsibility in or on the <br /> Premises as provided by law.
