a. Permit Finding. Pursuant to Municipal Code Chapter 30 (Subdivisions), <br />Article XI (Condominiums) the project requires approval of a Condominium <br />Permit. Section 30.130 states: "While condominium and community <br />apartment projects present benefits in the nature of increased amenities, <br />opportunities for dwelling ownership and leisure time, the special nature of <br />such projects creates conditions that may result in neglect, deterioration <br />and lack of maintenance, causing a negative impact upon the public <br />health, safety, welfare and economic prosperity of the City and its citizens. <br />Because of the unique nature of the problems created by condominium <br />and community apartment projects, it is the express intent of the City to <br />treat such projects differently from other types of multiple -family dwellings <br />and to establish rules and standards therefor, regulating the construction <br />of, and conversion to, condominium projects and community apartment <br />projects in the City." <br />The Project as proposed complies with the requirements of Article XI of <br />the Subdivision Ordinance as the project proposes meter and control <br />valves, noise and energy insulation as required and the project is <br />consistent with the zoning and general plan designation for the site. <br />Section 5. Planned Development Permit (PD2018-004): The Planning <br />Commission finds that approval of a Planned Development Permit is appropriate <br />for the proposed Project, as follows: <br />a. Permit Finding. Decisions regarding a Planned Development Permit shall <br />be based upon the purpose statement in this section. The design and <br />construction quality contained in all aspects of the development plan is <br />expected to exceed the quality standards typically required for new <br />developments located in similar zoning districts. <br />A Planned Development Permit is required to establish a condominium <br />map. No deviations are being requested. The project would be required to <br />form a homeowners association (HOA) and develop covenants, conditions <br />and restrictions (CC&Rs) that would ensure ongoing maintenance of <br />shared common space. The Project will provide an environment of <br />physical and functional desirability, in harmony with the character of the <br />surrounding neighborhood as the project is designed with sufficient <br />setbacks, provides adequate open space and on-site circulation for the <br />intended use and is compatible with the adjacent land uses. <br />Section 6. Architectural Permit (AP2018-011): The Planning <br />Commission finds that: <br />a.
