significant and unavoidable impacts, and because it does not achieve the City's and the applicant's <br />objectives for the Project to the same degree as the proposed Project, the City hereby finds that the <br />Increased Residential Alternative is not feasible. <br />Findings Relating to No Office Alternative. The No Office Alternative would avoid all of <br />the proposed Project's significant and unavoidable impacts. Specifically, due to the lack of office <br />development and associated substantial reduction in daily vehicle trips, the No Office Alternative <br />would avoid the proposed Project's significant and unavoidable cumulative noise impact and all <br />of its significant and unavoidable traffic impacts. (DEIR at 6-28 to 6-30) However, the No Office <br />Alternative would not achieve or promote the City's and the applicant's objectives for the Project <br />to the same degree as the proposed Project. (DEIR at 6-33 and Table 6-6) Specifically, the No <br />Office Alternative would not achieve the objectives of (i) providing employment opportunities and <br />neighborhood -serving retail uses in the area between City's downtown and the Mid -Point <br />Technology Park, and (ii) creating a mixed-use development that places residential and <br />commercial uses in close proximity to each other and to transit options. Because the No Office <br />Alternative does not adequately achieve the City's and the applicant's objectives for the Project, <br />the City hereby finds that the No Office Alternative is not feasible. <br />VI. Statement of Overriding Considerations. <br />Approval of the Project by the City Council will result in significant adverse environmental <br />effects which cannot be mitigated or avoided, notwithstanding the City has adopted all feasible <br />mitigation measures. The City Council has examined alternatives to the proposed Project that <br />could avoid or reduce the Project's significant and unavoidable effects and determined that <br />adoption and implementation of the proposed Project is the most desirable, feasible, and <br />appropriate action. Therefore, in accordance with Public Resources Code Section 21081(b) and <br />CEQA Guidelines Section 15093, makes the following Statement of Overriding Considerations, <br />which reflects it's balancing of the Project's benefits against its significant and unavoidable effects <br />and states the specific reasons for its decision to approve the Project. Substantial evidence supports <br />the various benefits and can be found at a minimum in the preceding CEQA findings, which are <br />incorporated by reference into this Statement, the EIR, and the other documents which make up <br />the record of proceedings. <br />A. Significant and Unavoidable Impacts <br />Based on the information and analysis set forth in the DEIR and the record of proceedings, <br />implementation of the proposed Project would result in the following significant unavoidable <br />impacts even with the implementation of all feasible mitigation measures: <br />Impact NO -7: The proposed Project, in combination with past, present, and reasonably <br />foreseeable projects, would result in significant cumulative impacts with respect to noise. <br />Impacts TT -1 and TT -7: Implementation of the proposed Project would result in a significant <br />and unavoidable impact, and would contribute to a significant cumulative impact, at the <br />following intersections: <br />Veterans Boulevard and Woodside Road; <br />Broadway and Woodside Road; <br />ATTY/RES0.0036/PC RESO CERTIFYING THE EIR — SOBRATO <br />REV: 04-29-19 PR <br />Page 27 of 29 <br />
