7.3.2 In the event of an employee absence, to avoid putting an apparatus <br />out of service, the department may temporarily reduce staffing to <br />three (3) people per apparatus while relief staff is being hired. <br />7.3.3 The regular work schedule for employees in the classification of <br />Deputy Fire Marshal and Fire Prevention Officer shall be forty (40) <br />hours in a seven (7) -day work week (typically five [5] consecutive <br />eight [8] -hour days), with the option of working an alternative work <br />schedule based on the operating needs of the department. The work <br />schedule is subject to approval by the Fire Chief and can be changed <br />at any time. <br />7.4 Starting Time <br />The regular starting time for Fire Fighter/Engineers and Fire Captains scheduled <br />for a fifty-six (56) hour workweek shall be 8:00 A.M. <br />7.5 Overtime <br />7.5.1 Fifty-six (56) Hour Workweek Employees <br />For the purposes of this MOU, overtime for employees in the <br />classifications of Fire Fighter/Engineer and Fire Captain is authorized <br />time worked beyond the employee's regularly scheduled hours in <br />Section 7.3. Overtime shall be compensated at one and one-half <br />(1.5) times the employee's regular rate of pay for any time worked <br />beyond a Fire Fighter/Engineer or Fire Captain's regular twenty-four <br />(24) hour work shift. For the purposes of this MOU, the regular rate <br />of pay shall be defined as the employee's base hourly rate of pay <br />based on a 56 hour work week (112 hours per pay period), and <br />including incentives or other forms of pay (paramedic pay, special <br />equipment operator (fire boat pilot) incentive, educational incentive, <br />EMT incentive, bilingual differential, holiday compensation). Overtime <br />must be authorized by the Fire Chief, or designated representative, <br />prior to such overtime being worked. <br />For the purposes of calculating overtime under the Fair Labor <br />Standards Act ("FLSA'% the City has adopted a twenty-four (24) -day <br />work period, pursuant to 29 U.S.C. § 207(k), to which Shift Employees <br />are subject. <br />7.5.2 Compensatory Time <br />Upon request, employees shall be compensated for overtime in <br />compensatory time off. An employee's compensatory time off (CTO) <br />balance shall not exceed seventy-two (72) hours at any given time. <br />CTO shall not be earned for work performed that is reimbursable by <br />the State or Federal government, including backfilling for employees <br />
