the City, the employee shall assign or endorse to the City any benefit payments <br />received as a result of Workers' Compensation insurance coverage. The City <br />reserves the right to withhold payment of any disability benefits until such time <br />it is determined whether or not the illness or injury is covered by Workers' <br />Compensation. However, an employee may use other leave accruals during such <br />time. <br />The benefits of sick leave and disability leave shall be mutually exclusive; and no <br />disability leave may be used for the purposes specified under Section 18.1, Sick - <br />Leave; and no sick leave benefits may be used for the purposes specified under <br />Section 18.4, Disability -Leave. <br />Employees in the above-mentioned classifications shall continue to accrue sick <br />leave and vacation leave benefits and receive payment for holidays during the <br />period of disability to a maximum of one (1) year or until retirement, whichever <br />occurs first. <br />18.5 Military Leave <br />Military leave shall be granted by the City in accordance with the provision of <br />state and federal laws, and there may be a deduction for any military <br />compensation that the employee receives for service during the period that <br />he/she is receiving full pay from the City, if permitted by law. All employees <br />taking military leave shall give the City an opportunity, within the limits of military <br />regulations, to determine when such military leave shall be taken. <br />18.6 Leave of Absence Without Pay <br />Any employee desiring a leave of absence without pay from his/her employment <br />for any reason shall secure written permission from the Personnel Officer and the <br />Fire Chief. The decision of the Personnel Officer or the Fire Chief on granting or <br />refusing to grant a leave of absence or extension thereof shall be final and <br />conclusive, and shall not be subject to the grievance procedure of this MOU. <br />Except as otherwise provided in this Section, the maximum leave of absence shall <br />be for one (1) year. <br />During any approved leave of absence, the employee shall not engage in gainful <br />employment unless authorized to do so by the written permission of the <br />Personnel Officer and the Fire Chief. The Personnel Officer and the Fire Chief <br />may terminate any employee who violates the terms and conditions of the written <br />permission for leave or extension thereof. <br />18.7 Jury Duty and Personal Court Appearances <br />Jury Duty and appearances in court and administrative proceedings (other than <br />appearances on behalf of the City and in accordance with official duties) shall be <br />handled in accordance with City Administrative Policy in effect as of the date of <br />this agreement, and as subsequently amended subject to notice to the <br />40 <br />
