For the purpose of the following fringe benefits, Library employees assigned to a regular schedule <br />of thirty-eight (38) hours per workweek shall be treated as full time employees: <br />1. Cafeteria Plan Allowance <br />2. Bereavement Leave, and <br />3. The calculation of service years for the purpose of seniority determination and retiree health <br />benefits <br />16.2 Overtime <br />16.2.1 Overtime is to be paid after forty (40) hours in paid status in one (1) work week, and for work <br />performed in excess of eight (8) consecutive hours in one (1) day (exclusive of lunch period), except <br />as provided in Article 16.2.2 below. <br />16.2.2 An employee who is assigned to a shift consisting of more than eight (8) consecutive hours (exclusive <br />of lunch period) shall be entitled to overtime after forty (40) hours in paid status in one (1) work week. <br />Employees in positions exempt from the FLSA who are assigned to work a shift of more than eight <br />(8) consecutive hours per day (exclusive of lunch period) shall be entitled to overtime if they are in <br />paid status more than eighty (80) hours in a biweekly pay period. <br />16.2.3 Employees required to work in excess of the regularly scheduled hours of work shall be compensated <br />for such overtime service at the rate of one and one-half (1.5) times the employee's regular straight - <br />time rate. The foregoing shall apply to the first shift in excess of five (5) consecutive shifts that an <br />employee may be required to work as result of a change in shift schedule. <br />16.2.4 Payment for overtime work will be either cash or compensatory time off at the employee's option. <br />Employees may accumulate a maximum of eighty (80) hours of compensatory time off which may <br />be used at times chosen by the employee and approved by the Department Head. For those who <br />elect to earn compensatory time, once an employee accumulates eighty (80) hours of compensatory <br />time off, the employee shall be compensated in cash for any overtime worked, until such time the <br />employee reduces his or her compensatory time bank to less than eighty (80) hours. <br />16.2.5 An employee may elect to receive compensation in lieu of compensatory time credits for any calendar <br />year by requesting payment in writing to the Director of Finance on or before December 1 of the <br />previous calendar year. Payment shall be made for the number of hours as specified by the <br />employee up to the total number of hours earned as of December 31st the following calendar year. <br />Payment shall be made to the employee by the first pay period in February. Employees will be <br />entitled thereafter to accrue up to eighty (80) hours again, subject to the same limitations. <br />16.3 Shift Differential <br />16.3.1 Any employee who is scheduled to work a twelve (12) hour shift that commences at or after the hour <br />of 1:00 p.m. and requires the employee to work until or past 11:00 p.m., or any employee who is <br />scheduled to work an eight (8) hour shift that commences at or after 3:00 p.m., and requires the <br />employee to work until or past 11:00 p.m., shall be paid an additional five percent (5%) for each hour <br />worked. <br />16.3.2 For employees who have been regularly working a shift differential -eligible shift for thirty (30) or <br />more days immediately preceding a paid holiday, or the commencement of a vacation, or the <br />29 <br />
