representation to the CITY that, based on PM's observations at the site, the data in <br />each application for progress payment, and to the best of PM's knowledge, information <br />and belief, the work has progressed to the point indicated in the application for <br />progress payment and the quality of the work is in generally in accordance with the <br />contract documents; <br />(iii) PM's representations relative to applications for progress payment are subject to an <br />evaluation of the work for conformity with the Project requirements. Minor <br />deviations are allowed from requirements if correctable prior to end -date of work <br />billed. <br />(iv) PM's payment recommendation pursuant to the preceding shall be a <br />representation thatthe Contractor is entitled to payment in the amount so certified. The <br />PM's review of applications for progress payment shall be completed within five (5) <br />working days of submittal by Contractor so that the CITY can meet its obligations <br />to make progress payment due the Contractor within the time permitted by <br />applicable law without incurring interest liability or other penalties/liabilities. If PM <br />is unable to complete review within this time, PM shall either notify CITY or reject <br />the application for payment in writing and include specific reasons. <br />(v) PM shall track all applications for payment received, including rejected and late <br />applications for payment. <br />3.4 Requestfor Information ("RFI"). PM shall work with the Architect to recommend a <br />process and procedure for the submission, review and response to the <br />Contractor(s)' RFIs. Once this process is approved by the CITY, the PM shall <br />implement such processes and procedures during construction of the Project. In <br />addition to such processes and procedures, the PM shall either a log of RFIs <br />("RFI Log"). The PM shall ensure that the RFI Log contains at least the <br />following: <br />(i) summary table of RFIs; <br />(ii) sequential numbering of RFIs; <br />(iii) dates of: submission of each RFI, transmittal ofthe RFl to the Architect, theArchitect's <br />response to the RFI and the transmittal of the Architect's response to the <br />Contractor; and, <br />(iii) actual or potential cost and time impact of each RFI and the response to each <br />RFI. The PM's RFI Log shall include an assessment of the responsibility for <br />any time or cost impacts arising out of an RFI or the response thereto. The <br />RFI Log shall be available for review, inspection and/or reproduction by the <br />CITY upon request. <br />3.5 Submittals. PM shall work with the Architect and Contractor to recommend a <br />process and procedure for the submission, review and response to the <br />Contractor(s)' submittals. <br />The PM shall monitor and track Contractor's log of submittals ("Submittal Log") <br />for the Project.
