PM's responsibilities hereunder shall be limited to defective or deficient work of an apparent and patent nature. 3.10 Site Safety 3.10.1 CITY Safety Program. Prior to any performance of work at the site, the PM shall review the safety requirements for the Project and verify that the Contractor implements a safety program during construction, whenever Contractor personnel is onsite, and for public safety. 3.10.2 Contractor Safety Programs. PM shall review safety programs of the Contractor for conformity with requirements of the construction documents and applicable law; PM shall monitor the Contractor's compliance with their respective safety programs and immediately advise the Contractor of deficiencies. PM shall document non-conformance in the daily report. If Contractor does not comply within a reasonable timeframe to ensure safety, PM shall advise the CITY of measures, if any, necessary or appropriate to obtain the Contractor's compliance. By undertaking the obligations hereunder, PM shall not be deemed to have assumed responsibility for the adequacy or sufficiency of safety programs implemented by Contractor, but the PM is responsible for verifying that the Contractor has established a safety program, that the safety program established by the Contractor is in compliance with the construction documents and applicable law, rule or regulation and that the Contractor implements its safety program during construction of the Project. 3.10.3 Safety Violations; Safety Conditions. The PM shall promptly notify and document to the CITY in writing of all PM observed instances of the Contractor(s) failure to comply with applicable safety requirements or safety programs. In the event of a safety violation or other unsafe conditions on or about the site of the Project which have immediate potential or actual adverse effect on life or property, the PM is authorized, without prior notice to CITY or prior directive of the CITY, to take all actions deemed necessary and appropriate by the PM under the then existing circumstances to prevent such actual or potential adverse effect. 3.11 Changes and Claims. 3.11.1 Coordination of Changes. PM will coordinate and disseminate correspondence, drawings and other written materials by and between the Contractor(s), the CITY, testing/ inspection service providers and the Architect relating to changes to the work of the Project.
