(ii) CITY review and approval/acceptance of modified design documents relating to a change: and (vi) the Contractor(s)' performance of changes authorized by the CITY. PM will maintain a log and detailed records to monitor the status and disposition of changes and change orders. The detailed records shall provide status information: 1. the actual or potential impact of any particular change or change order; 2. photographic documentation throughout change; 3. daily reports from the time period spanning the change; 4. quantities of the changed condition; 5. description of change from the baseline condition; and, 6. the cumulative effects thereof on construction costs and time for completing construction of the Project. The change order log shall summarize the change and the detailed records shall include an evaluation of the underlying reason(s) for implementing a change or change order. The change order log and detailed records maintained by the PM shall be available for review, inspection and reproduction upon request of the CITY. 3.11.2 Processing of Changes and Change Orders. PM will assist the CITY and the Architect in evaluation of requests by Contractor(s) for issuance of change orders and will confer with the CITY prior to the PM negotiating change order proposals and the adjustment of contract price, time, or deliverables under the Contractor's contract. PM will make recommendations to the CITY and the Architect for handling and disposition of the change order proposals. If a change to the Contractor's contract is approved or authorized by the CITY, PM will assist the CITY and the Architect in the preparation of a change order reflecting such approved or authorized change to the Contractor's contract. The PM is not authorized, without the prior written consent and approval of the CITY, to effectuate or authorize any change to the work of the Project. The PM shall be liable to the CITYfor all direct and consequential costs, losses or damages resulting from the PM's direction or authorization to effectuate a change to the work of the Project without the prior direction and authorization of the CITY. 3.11.3 Claims Handling. PM will assist the Architect in the review, evaluation and processing of claims asserted by Contractor; PM will make recommendations to the CITY as to merit, handling and disposition of Contractor(s)' claims. Services of the PM to prepare documentation for or provide testimony in a mediation, arbitration or judicial proceeding arising out of such a claim or demand for compensation shall be deemed additional services. 3.12 Building Testing and Commissioning. The Project will be a LEED Platinum rating. PM shall advise CITY, Architect, and commissioning agent/authority ("CxA") when the Contractor is ready for testing and commissioning of systems per REV: 08-21-19 PR
