01/10/2011 <br /> 8.4 Holiday During Vacation or Sick Leave <br /> In the event any of the holidays specified in Section 8.1 above occurs while an <br /> employee is on vacation or sick leave, the holiday shall not be charged as <br /> vacation or sick leave. <br /> 8.5 Holiday Compensation for Fire Fighter /Engineer and Fire Captain <br /> Each employee in the classifications of Fire Fighter /Engineer and Fire Captain <br /> assigned to a twenty -four (24) hour duty schedule shall be exempt from the <br /> provisions of Sections 8.1, 8.2, 8.3 and 8.4 above, and shall receive no <br /> additional compensation in the form of pay or time off in the event the <br /> employee is required to work on any of the days set forth in Section 8.1. <br /> Fire Fighter /Engineers and Fire Captains who are in a no -pay status (e.g. on <br /> leave of absence or Family Medical Leave) will receive holiday compensation on <br /> a prorated basis. <br /> In lieu of any holiday benefits, each employee shall receive compensation in the <br /> amount of one and one -half (1 -1/2) times his /her pay, calculated on the basis <br /> of an eight (8) hour day, for eighty (80) hours in each calendar year. Such <br /> compensation shall be issued in the amount of forty (40) hours on the first pay <br /> day on or immediately following June 1, and an additional forty (40) hours on <br /> the first pay day on or immediately following December 1. Holiday checks will <br /> be issued separately from the normal pay period checks. Employees who are <br /> laid off or whose service with the City is terminated prior to June 1 or <br /> December 1 shall have their holiday compensation pro- rated. <br /> Effective December 20, 2010, in lieu of the two (2) administrative holidays, <br /> each employee shall receive compensation in the amount of forty-eight (48) <br /> hours at the forty (40) hour rate in each calendar year. The City will endeavor <br /> to make the 2010 payment on the first non - payroll Friday within 30 days of <br /> contract ratification and Council approval of an agreement. The City will <br /> endeavor to make the 2011, 2012 and 2013 payments on the first non - payroll <br /> Friday in January of the respective year, however the payment will be made no <br /> later than the first pay period in February. Administrative holiday checks will be <br /> issued separately from the normal pay period checks. <br /> In the event that one or both of the administrative holidays have already been <br /> used for calendar year 2010, employees may transfer equivalent hours from <br /> their accrued vacation balances and /or compensatory time balances. The <br /> resulting administrative holiday balance will be paid out according to the <br /> paragraph above. Authorization forms will be provided for those employees <br /> who choose to transfer hours. For those employees who have already used <br /> their administrative holiday(s) in 2010, only those who submit authorization <br /> forms will have their hours transferred and have their reestablished <br /> administrative holiday hours included in the 2010 holiday compensation <br /> payment noted in the paragraph directly preceeding this one. <br /> 21 <br /> Page 27 #15077 <br /> MUFF # 905 <br />
