01/24/2011 <br /> Exhibit B <br /> Precise Plan that is the subject of this City Council action, and that is referred to herein as <br /> the "Project." <br /> Following the Planning Commission's action, the City Council reviewed <br /> the Draft DPP, Draft EIR and Final EIR, and considered the Planning Commission's <br /> recommendations. Exercising its independent judgment, the City Council hereby makes <br /> the following findings of fact and statements of overriding considerations (collectively, the <br /> "Findings ") to support its certification of the EIR and approval of the new Downtown <br /> Precise Plan Project recommended by the Planning Commission. These Findings contain <br /> the City Council's written analysis and conclusions regarding the Project's environmental <br /> effects, mitigation measures, alternatives to the proposed Project, and the overriding <br /> considerations which, in the City Council's view, justify the approval of the Project despite <br /> its potential environmental effects. These Findings are based upon the entire record of <br /> proceedings for the Project and the EIR, as described below. <br /> The approvals necessary for implementation of the Project are: <br /> • Certification of the EIR for the Downtown Precise Plan and adoption of the <br /> accompanying Mitigation Monitoring and Reporting Plan (the "MMRP "); <br /> • Amendment of the City's 2010 General Plan to ensure consistency <br /> between the 2010 General Plan and the proposed Downtown Precise Plan <br /> recommended by the Planning Commission; <br /> • Adoption of the proposed Downtown Precise Plan recommended by the <br /> Planning Commission; and <br /> • Rezoning of the Downtown Precise Plan area to designation "P" under the <br /> City's Zoning Ordinance. <br /> The EIR was prepared to meet all applicable CEQA requirements necessary to support <br /> these actions by the City Council. <br /> II. General Findings and Overview <br /> A. Record of Proceedings and Custodian of Record <br /> For purposes of CEQA and these Findings, the record of proceedings for the <br /> City's findings and determinations consists of the following documents and testimony, <br /> at a minimum: <br /> • The EIR, which consists of the Draft Environmental Impact Report <br /> for the Redwood City Downtown Precise Plan (State Clearinghouse No. 2006052027), <br /> published and circulated for public review and comment by the City from August 31, <br /> 2010, through November 5, 2010 (the Draft EIR), and the Final Environmental Impact <br /> Report for the Redwood City Downtown Precise Plan, published and made available for <br /> public review on December 1, 2010 (the Final EIR), and all appendices, reports, <br /> U:\Resolutions\2011\Reso 15086 Exhibit B.doc 2 <br /> 012011 Reso. # 15086 <br /> Muff #601 <br />
