11/18/2013 <br /> Section 5. Planned Development Permit (PD2013-07): In denying the <br /> appeal and approving Planned Development Permit No. PD2013-07 for the Project as <br /> revised on November 8, 2013, the City Council finds that the project will provide an <br /> environment of physical and functional desirability, in harmony with the character of the <br /> surrounding neighborhood and Downtown Precise Plan area. <br /> Section 6. Downtown Planned Community Permit (DPC2012-09): In <br /> denying the appeal and approving the Downtown Planned Community Permit No. <br /> DPC2012-09 for the Project as revised on November 8, 2013, the City Council finds that: <br /> a. The project and improvements proposed by Planned Community <br /> Permit Application No. DPC2012-09 are consistent with, conform to the intent of, and <br /> will appropriately implement the Downtown Precise Plan for the 525 Middlefield Road <br /> project; <br /> b. The establishment, maintenance and operation of the project and <br /> improvements proposed by Planned Community Permit No. DPC2012-09 will not, under <br /> the circumstances of this particular case, be detrimental to the health, safety peace, <br /> morals, or general welfare of persons residing or working in the neighborhood of the <br /> project, or be detrimental or injurious to property or improvements in the neighborhood <br /> of the project, or to the general welfare of the City, because the project has been found <br /> to be consistent with the community goals established in the City's General Plan and <br /> Zoning Ordinance; <br /> c. The Project and improvements comply fully with all applicable <br /> standards of the DTPP; <br /> d. The Project and improvements comply with all but six guidelines of <br /> the DTPP. The aspects of the Project which do not conform to the guidelines of the <br /> DTPP nonetheless adequately promote the overall intent of the DTPP and <br /> e. The project and improvements proposed by Planned Community <br /> Permit Application No. DPC2012-09 do not adversely affect the adjacent Historical <br /> Resource located at 605 Middlefield. <br /> Section 7. The Tentative Map, Condominium Permit, Planned Development <br /> Permit and Planned Community Permit for the Project as revised on November 8, <br /> 2013, are hereby approved based on the City Council's consideration and reliance <br /> on the Initial Study (IS) and Downtown Precise Plan EIR, and in accordance with the <br /> plans, details and descriptions contained herein, attached hereto and incorporated <br /> herein by reference, and subject to the following Conditions of Approval: <br /> CONDITIONS OF APPROVAL: <br /> 1. Applicant shall insure that all improvements substantially conform to the <br /> ATTY/RE50.2925/APPEAL OF 525 MIDDLEFIELD RESO. #15305 <br /> REV:11-13-13 VR MUFF#603 <br /> Page 5 of 12 <br />
