The fencing along the rear yards of the lots that directly abut Cordilleras Creek shall <br />be decorative, such as wrought iron or split rail finished in dark or earth-tone colors. <br />The fencing may not extend beyond the top of bank of Cordilleras Creek. The <br />fencing parallel to the creek shall be constructed as part of the subdivision <br />improvements. There shall be a gate constructed in the fence for each of the four <br />lots adjacent to the creek. The specific design, materials and color of the fencing <br />shall be submitted as part of the subdivision improvement plans and shall be to the <br />satisfaction of the Planning Manager or designee. <br /> <br />25. The proposed development shall not be gated. <br /> <br />26. There are three existing driveways into the project site. Those portions of these <br />driveways outside of the intersection of the private roadway with Finger Avenue shall <br />be reconstructed to match the existing street improvements along Finger Avenue, <br />including the sidewalk, planting area, and curb and gutter. The installation of new <br />street trees and maintenance for at least two years until they are established is <br />required to ensure that the spacing of street trees along Finger Avenue is continued <br />across the project’s frontage on Finger Avenue. Street trees species, spacing and <br />size shall be coordinated with the City’s Landscape Architect. <br /> <br />27. Applicant shall submit to the City for review and approval Covenants, Conditions and <br />Restrictions that demonstrate how applicant intends to use a Home Owner’s <br />Association to implement and comply with common area Conditions of Approval and <br />CEQA Mitigation Measures. The Covenants, Conditions and Restrictions (CC&Rs) <br />shall provide for the maintenance of all infrastructure and utilities within the project site <br />or constructed with encroachment permits within the Finger Avenue right-of-way to <br />serve the project which serve two or more lots and are not accepted by the City or a <br />utility company for maintenance. This shall include, but not be limited to, the private <br />roadway, the shared guest parking spaces, sidewalk, common landscaping, and the <br />stormwater drainage and sewer collection systems. The CC&Rs shall be submitted to <br />the City Engineer or designee for review and approval prior to Final Map approval. <br />The CC&Rs shall be recorded with the Final Map. <br /> <br />28. All infrastructure and utilities serving two or more lots shall be located within <br />easements to provide for ongoing maintenance and possible replacement. The <br />easements shall be to individual property owners or the Homeowners Association, or, <br />where the utilities and infrastructure is to be accepted by the City or a utility company, <br />a Public Utilities Easement shall be provided. These easements shall include a public <br />utilities easement to the satisfaction of the City Engineer, if the City accepts the water <br />and sewer mains within the private street for maintenance purposes. These <br />easements shall be shown on the Final Map. <br /> <br />29. Applicant shall submit improvement plans which include complete sets of plans, <br />profiles, cross sections and specifications for the proposed improvements which <br />shall be in conformity with the current design standards in force and the standard <br />specifications of the City unless exceptions have been granted, on reproducible
