11/16/2015 <br /> WHEREAS, at the June 30, 2015 public hearing, pursuant to Section 2.0.3-A-2- <br /> a on page 30 of the DTPP, the Planning Commission considered and accepted the <br /> recommendation of the HRAC regarding the adjacent Historic Resources located at <br /> 611 Middlefield Road, 620 Jefferson Avenue and the historic San Mateo County <br /> Courthouse at 2200 Broadway; and <br /> WHEREAS, at the June 30, 2015 public hearing, the Commission determined <br /> that the proposed Vesting Tentative Map, Downtown Planned Community Permit <br /> including two guideline deviations, and Parking In-Lieu Fee Application would further the <br /> purposes of and appropriately implement the City of Redwood City General Plan, <br /> applicable provisions of the Redwood City Municipal Code, the City Zoning Ordinance <br /> and Downtown Precise Plan, and the Nine-Story Project, and approved the Nine-Story <br /> Project; and <br /> WHEREAS, three appeals were filed with the City during the 15-day appeal <br /> period by 1) J&S Management c/o Tanya Gulesserian, Adams, Broadwell, Joseph & <br /> Cardozo, 2) Richard and Sally Keyes, and 3) Geoffrey T. Carr (collectively, Appellants) <br /> challenging the Planning Commission's approval of the Nine-Story Project; and <br /> WHEREAS, the matter was duly noticed for a de novo public hearing before the <br /> City Council on September 28, 2015; and <br /> WHEREAS, on September 28, 2015, the City Council conducted a duly noticed <br /> de novo public hearing in accordance with all applicable requirements of the <br /> Subdivision Map Act and the Redwood City Municipal Code, all applicable <br /> requirements of the State Planning and Zoning Law, the City Zoning Ordinance and <br /> the Downtown Precise Plan, to consider the appeals of the Nine-Story Project, and <br /> received and considered oral and documentary evidence on the appeals and <br /> application; and <br /> WHEREAS, the City Council, with knowledge that the Applicant had recently <br /> negotiated settlement agreements with each of the three Appellants, voted 6-0 (Howard <br /> recused) to continue the public hearing in order for Staff and the City Council to review <br /> the settlement agreements; and <br /> WHEREAS, two of the three settlement agreements include a reduced project <br /> consisting of an 8-story, 105' tall, 124,220 square foot office building with two levels of <br /> underground parking, indoor bicycle storage for 78 bicycles, a total of 255 on-site <br /> ATTY/RE50.3157/SA RESO 601 MARSHALL APPEAL 8-STORY PROJECT RESO.#15458 <br /> REV: 11-16-15 VR MUFF#603 <br /> Page 3 of 23 <br />
