6.10 tenant improvements, the spatial limitations of the pavilions, and the uncertainties of Page 2 pioneering food services in Courthouse Square has caused staff to question whether the original goals can be met unless there is some re-thinking of how best to utilize the pavilions. Therefore, the Committee has asked staff to come back with a list of options and pro's / con's for other approaches. Concurrently, it was generally agreed that moving ahead with this first lease will provide valuable additional experience with a willing vendor, so staff is recommending that Council authorize the lease and license within this framework. Daily Boost LLC Lease Daily Boost LLC proposes to operate a coffee, expresso drinks, smoothies, healthy pastries, breakfast sandwiches and wraps, prepacked sandwiches, nuts and soy products, and fruit cup concession called "Daily Boost" within Lease Area 1 B located near the Courthouse building along Middlefield in Courthouse Square as shown in Exhibit A. Daily Boost will enter into a lease with the Agency for the 190 square foot area. The expected opening date of Daily Boost is January 2008. The key terms of the lease consist of the following: . Initial fiye year term; . Two five-year options to extend the term; and . Lease rate of $3.00 per square foot. In an effort to ensure a successful start, Daily Boost will pay $1.00 per month to the Agency for the first six months, commencing January 15, 2008 to ease its business start-up costs and operations. Since Daily Boost will likely be the only vendor in operation for the first few months, this provision would allow for a ramp-up period, until all vendor spaces are occupied and operating. As a result, more actiyity is expected and full charges will be implemented at that time. Daily Boost LLC License Daily Boost LLC will enter into a license with the City for License Area 1 B as shown in the plat map and legal description as Exhibit A in the License Agreement. The license area, measuring approximately 43' x 36' (1,360 square feet) will have 16 tables and 32 chairs provided by the City for Daily Boost's use, and shall be available to the public without purchase requirement during Daily Boost's hours of operations. Daily Boost will clean and bus the tables and chairs during hours of operations. The key terms of the license agreement consist of the following: . Month-to-month term . License fee of $.06 per square foot per month for a total of $81.75 per month . Common area maintenance of $600 per month The license fee is a nominal amount to encourage Daily Boost to clean the tables and chairs provided by the City. The common area maintenance charge of $600 per month commences January 15, 2008. License fees collected will fund City sponsored or co-sponsored special events at Courthouse Square. The common area maintenance charges collected will fund a portion of the maintenance of Courthouse Square such as power washing and landscaping.
