<br />6.10 <br /> <br />tenant improvements, the spatial limitations of the pavilions, and the uncertainties of Page 2 <br />pioneering food services in Courthouse Square has caused staff to question whether <br />the original goals can be met unless there is some re-thinking of how best to utilize the <br />pavilions. Therefore, the Committee has asked staff to come back with a list of options <br />and pro's / con's for other approaches. Concurrently, it was generally agreed that <br />moving ahead with this first lease will provide valuable additional experience with a <br />willing vendor, so staff is recommending that Council authorize the lease and license <br />within this framework. <br /> <br />Daily Boost LLC Lease <br />Daily Boost LLC proposes to operate a coffee, expresso drinks, smoothies, healthy <br />pastries, breakfast sandwiches and wraps, prepacked sandwiches, nuts and soy <br />products, and fruit cup concession called "Daily Boost" within Lease Area 1 B located <br />near the Courthouse building along Middlefield in Courthouse Square as shown in <br />Exhibit A. Daily Boost will enter into a lease with the Agency for the 190 square foot <br />area. The expected opening date of Daily Boost is January 2008. The key terms of the <br />lease consist of the following: <br /> <br />. Initial fiye year term; <br />. Two five-year options to extend the term; and <br />. Lease rate of $3.00 per square foot. <br /> <br />In an effort to ensure a successful start, Daily Boost will pay $1.00 per month to the <br />Agency for the first six months, commencing January 15, 2008 to ease its business <br />start-up costs and operations. Since Daily Boost will likely be the only vendor in <br />operation for the first few months, this provision would allow for a ramp-up period, until <br />all vendor spaces are occupied and operating. As a result, more actiyity is expected <br />and full charges will be implemented at that time. <br /> <br />Daily Boost LLC License <br />Daily Boost LLC will enter into a license with the City for License Area 1 B as shown in <br />the plat map and legal description as Exhibit A in the License Agreement. The license <br />area, measuring approximately 43' x 36' (1,360 square feet) will have 16 tables and 32 <br />chairs provided by the City for Daily Boost's use, and shall be available to the public <br />without purchase requirement during Daily Boost's hours of operations. Daily Boost will <br />clean and bus the tables and chairs during hours of operations. <br /> <br />The key terms of the license agreement consist of the following: <br /> <br />. Month-to-month term <br />. License fee of $.06 per square foot per month for a total of $81.75 per month <br />. Common area maintenance of $600 per month <br /> <br />The license fee is a nominal amount to encourage Daily Boost to clean the tables and <br />chairs provided by the City. The common area maintenance charge of $600 per month <br />commences January 15, 2008. <br /> <br />License fees collected will fund City sponsored or co-sponsored special events at <br />Courthouse Square. The common area maintenance charges collected will fund a <br />portion of the maintenance of Courthouse Square such as power washing and <br />landscaping. <br />
