<br />ATTACHMENT 5 7A <br /> <br />referenced above and based on the findings that: 1) as revised, the project conformfage 44 <br />to the amended Precise Plan; and 2) as revised, the establishment, maintenance or <br />operation of the use applied for will not, under the circumstances of the particular <br />case, be detrimental to the health, safety, peace, morals or general welfare of <br />persons residing or working in the neighborhood of said proposed use, or be <br />detrimental or injurious to property and improvements in the neighborhood, or to the <br />general welfare of the City. Refer to Attachment 0 for project plan submittal. <br /> <br />3. Approve the Vesting Tentative Map for the proposed project. Final Map approval <br />can not be granted until City Council adoption of the Zoning Map Amendment and <br />revised Precise Plan. Refer to Attachment 0 for Vesting Tentative Map plan <br />submittal and Attachment E for draft conditions of approval. <br /> <br />BACKGROUND <br />Staff has been working closely with neighborhood representatives (through e-mails, <br />phone calls, website postings and a recent meeting in early August at City Hall to review <br />revised project plans) in order to keep the neighborhood updated about the status of the <br />proposed project. The project review process has also included many public meetings <br />and hearings over the past year as summarized below: <br />· In June 2006, the Planning Commission held a Study Session and recommended <br />initiation of a project Precise Plan to the City Council. <br />· On June 27 and September 12,2006, the Architectural Review Committee (ARC) <br />reviewed and provided input on the project architecture. <br />· In October 2006, the City Council held a public hearing and approved initiation of <br />the project Precise Plan. <br />· On November 28, 2006, after a 30-day public review period, the Planning <br />Commission held a public hearing and adopted the Mitigated Negative <br />Declaration prepared for the Precise Plan, Zoning Map Amendment, and the <br />associated project and recommended Precise Plan approval to the City Council. <br />· On March 7, 2007, the City sponsored a community workshop, facilitated by the <br />Peninsula Conflict Resolution Center, to obtain additional public input. <br />Approximately 34 neighbors attended. <br />· On April 9, 2007, the City Council held a public hearing and, based on <br />community input, recommended returning the item to the Planning Commission <br />to amend the Precise Plan to require project access from Woodside Road <br />(instead of Horgan Avenue) and explore options to project height of four or five <br />stories to provide a smoother transition to the neighborhood. <br />· July 24, 2007, the ARC unanimously recommended approval of the project <br />architecture as redesigned. <br /> <br />PROJECT DESCRIPTION <br />Existinq Site: The subject site is a vacant, 0.66-acre, unusual L-shaped property with <br />frontage on both Woodside Road and Horgan Avenue and is bordered along most of its <br />front yard property line by an 11,000 square foot gas station site on the corner of <br />Woodside Road and Horgan Avenue. A four-story apartment complex (Montecito <br />Apartments at 79 units/acre) lies to the north and five single-family homes share a <br />common property line along the rear yard. A car wash, nursery school and the Enclave <br />condominiums also lie to the south, across Horgan Avenue. <br />
