<br />CES:mmg ~7/27/89 (#41/010) <br /> <br />8 . <br /> <br />RELEASE. <br /> <br />Permi ttee shall be solely responsible and <br /> <br />liable for all damages to persons or property, including injury <br /> <br />or death of persons or loss of use of property, due directly or <br /> <br />indirectly to Permittee's construction of the said improvements, <br /> <br />and the use permitted hereunder, and shall promptly pay any just <br /> <br />claim therefor and shall defend, indemnify and hold the City of <br /> <br />Redwood City, its Council, officers, boards, commissions, agents <br /> <br />and employees, harmless from all suits, actions, damages, or <br /> <br />claims to which said City may be subjected by reason of said <br /> <br />construction <br /> <br />and/or <br /> <br />maintenance <br /> <br />of <br /> <br />said <br /> <br />improvements <br /> <br />or <br /> <br />encroachment or use thereof permitted hereunder. <br /> <br />Permittee shall further release and hold City harmless from <br /> <br />any destruction to or alteration of Permittee's improvements by <br /> <br />City, or its employees, agents or contractors, (except as such <br /> <br />destruction or alteration is caused by willful act or gross <br /> <br />negligence) in the exercise of City's ownership rights to the <br /> <br />real property adjacent to and abutting the Subject Premises. <br /> <br />9. <br /> <br />INSURANCE. <br /> <br />Permittee shall secure, carry and maintain <br /> <br />at all times during the period covered by this revocable permit, <br /> <br />at Permittee's <br /> <br />sole cost and expense, <br /> <br />commercial general <br /> <br />liability and property damage insurance, which insurance shall be <br /> <br />in the following minimum amounts: <br /> <br />(a) $1,000,000 for injury or death of anyone person <br />and $1,000,000 for anyone occurrence; <br /> <br />4 <br />
